Thanks for great forum
I have a question with regards to a PCN issued. The Driver parked on this corner with no yellow line in the evening, no illuminated signs. Just the ones on the wall normally under balconies. Location Map on Google earth showing Yellow lines on some roads, and non on others. PCN is showing code 19 which i believe after reading is a residents permit code, however this is claimed to be a no parking area ? I have been advised by some to not pay as i will not hear anything else from them ? do i need to write to anyone or do i just file it with photos and wait for any letters ? thanks for reading Location Map This post has been edited by titch1644: Tue, 30 Jan 2018 - 14:43 |

This is a private not council ticket so I have asked for a move to the private parking forum.

First of all edit your post to remove any reference which suggests to whose car the PCN was attached. Simply say it was issued to the driver and leaave out any peripheral stuff about why the car was there in the first place.
Then redact the picture of the PCN you attached. It's showing the reference number and other details of the car. The PPCs often follow this forum and you don;t want to offer any hostages to fortune. This post has been edited by hexaflexagon: Tue, 30 Jan 2018 - 12:20 |

Is there anything more on the back of the ticket?
As this is a windscreen ticket, the advice is to appeal on day 26 using the "blue" template from here. This is to hopefully delay the NtK just long enough so they can no longer go after the keeper. However, ensure you appeal as the keeper, and DO NOT name the driver, no matter what you're asked. The good news is that, so far, this company appears to have never taken anyone to court, so hopefully this case is unlikely to get that far. That sign is not offering a parking contract, it merely says "no parking in this road", it can not then assume that a contract is created to allow something that was expressly forbidden.

In addition they may so please to have the keepers name and will save themselves £2.50 for DVLA access that even if the do issue a NTK in time then they may not have accessed the DVLA and so, again, they have shot themselves in the foot as far as keeper liability is concerned.

Card payments incur a £1.50 extra?
That's illegal now.... If you wanted to cause some fun with that you could report them to Trading Standards. Not sure if it would help the appeal process though - there are better legal minds than mine on here that could advise. |

oooh now my first letter has arrived NTK.
qu: do i email the address on the letter with the standard template letter ? do i leave this wording the same "I am not liable and I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs are in small print and the onerous terms are not readable." to suit the foreboding contract etc? |

You post it up here, suitably redacted, so that others can comment on it.
Did you appeal the windscreen ticket? If you did then a quick email to the DVLA to find out who accessed your data. Search for the address in the forum. This post has been edited by ostell: Mon, 26 Feb 2018 - 13:57 |

Check that the NTK contains the same information as the windscreen taicket. They must be the same to hold the keeper liable.
Have you checked with the dvla for information about who requested information about your car and when? |
