This posted on Twitter by Avon and Somerset Police, of interest that someone has tried the defence (probably not the first, but first I'm aware of).

ASPolice Roads Policing (RPU)

COURT RESULT: Incident on Stapleton Road from April '22

Driver pleaded NG stating "He was stationary at traffic lights & his car is equipped with the electronic stop/start function which means that the engine stopped"

Found guilty at Trial =
£288 Fine
£620 Costs
£34 VS
6 POINTS

One day, people might understand that whether the engine is running or not does not determine whether the person in the driving seat is "driving". That day will probably only come when we're all driving electric or hybrid cars where a running ICE is not really related to whether you're moving or not.

Anyways... What baffles me is why a modern car with S/S doesn't have Bluetooth or anyone who can afford such a car can't shell out a fiver for a holder?

We all probably see £100k+ cars with dickheads driving them whilst holding the phone. Technophobia maybe?
