Can someone help me out on this one ,please?
My company have had an email from the company that we lease our vans from, to say that I had a Yellow Box Junction fine in London, last month.
My boss forwarded the email to me, which has a link for payment on it.
Am I right in thinking that my boss needs to notify them who the driver was, so they can send me a paper notification, like Parking Fines?
I've got no chance of fighting it, as I was bang to rights- I just want to string it out a bit closer to pay day, without missing the discount period. My boss doesn't seem to grasp that there is a correct procedure but I want to be sure what it is before I speak to him.

Many London PCNs have legal flaws that makes them open to challenge. Also, civil PCNs are the liability of the owner, liability cannot be transferred to the driver. This means we can help you fight the PCN only if the registered keeper gives you permission to appeal on their behalf.

So, is your boss / the company named on the PCN? If the Pcn has been issued for example to a lease company, that adds a further layer of complexity.

See if you can get them to send a copy of the PCN (all pages) - not worth going through the transfer unless there's something to go on and there's always a risk of things going wrong.

To delay proceedings it might be possible ask the hire company to transfer liability.

This means that they write back to the Council and tell them the vehicle was on hire to Company X. Their PCN is cancelled and Company X gets a new one.

That's the simple answer which delays matters and might get the charge back to the discount level since it seems the hire company has not been quick to sort this out.

Post up the PCN if you can get hold of it but I think your boss needs to tell the hire company to contact the Council as above.

Thanks for the replies.
At the moment, I'm waiting for my boss to send the notice over. I've got a feeling that he isn't going to rush to do it though, which is why I wondered if the council re-issue it to me when they've been notified who was driving.
The email says that the lease company are notifying the council with the company name, so I'm presuming that my bosses name will be on it.
Is there a discount period on Box Junction tickets? I've had one before, but can't remember. The email doesn't mention one.

All council PCNs have discount periods by regulation, in this case 14 days.

If it's reissued to your company it won't be your PCN and only company can make reps and is liable, but you can write them.

Thanks- Apparently, our company are waiting for the PCN to come through so that should take it up to payday like i wanted. I viewed the video and I rolled into the box and was there for around a minute, as someone stopped me reversing out. Like I said- bang to rights!!
The annoying thing is that I think I've got another one coming from yesterday. I think I need to stop driving in London angry.gif angry.gif

Islington PCNs have a known flaw (see the PCN flaws database), you need to post up all sides of all pages so we can double check.

By the way if the company is your employer, you can make representations on behalf of the company in your capacity as an employee.
