Evening all. I've received a PCN from the above company. A driver was photographed (he thinks by a little man in a dark silver BMW 3 series touring) in a "No stopping area" on a Shell garage forecourt. The length of the stop according to the photographs is 7 minutes! The amount payable is for £60 rising to £100 after 14 days
Initial thoughts are; 1) Ignore 2) Send them a letter telling them I wont be naming the driver but they can pay me a £100 administration fee to find out who the driver was along with a fee schedule for dealing with the matter. The Judge went on to say how we both should’ve not been relying on email and in future should serve by post. Lesson learned! I thought we're encouraged to do more of this by email these days?
Because of this The Judge wouldn’t allow my claim for full costs and Litigant in person costs although she did allow me to claim for 2 hours loss of earnings, my parking and mileage. |

Isn't the end-game to run the entire process on-line ?
Personally I think the judge has a point - witness statements and evidence packs should be sent by post It's discourteous to put the recipient to the effort of printing and collating them It's also the only way to ensure that what is received is exactly what was sent |

Well let’s chalk it up to experience. In my opinion Gladstones knew exactly what they were doing.
It was their effort at damage limitation, They were trying to trip me up. As I said a couple of pages back they sent me their witness statement by email, from an address that wouldn’t accept incoming emails. If it weren’t for the poster who suggested an alternative email address I’d have missed the 14 day deadline. In fact I’m still not entirely sure how they got my email address in the first place. Can only assume they got it from the court! They’re obviously trying to utilise email to cut down on paperwork. |
