At the weekend I was knocked off my pushbike as I turned into a side street. A taxi driver somehow managed not to see me. He jumped out of his Taxi and hurled abuse at me stating I was cutting the corner. I then pointed out the position of his car was clearly about 1.5 meters on the wrong side of the road and it was clearly his fault. Anyway at this point he approached me and tried to thump me so I cycled off. Obviously I felt annoyed and frustrated that this buffoon could have squashed me but I got over it quite fast. Then when I got home I realised I that this was a Hit-and-run on my behalf but I only left the scene as I did not want to get into a kerfuffle with the aggressive taxi driver. I have a few questions that hopefully you can provide some assistance. 1.) I have a car licence/insurance but often cycle to work. If I have an RTA with a car when on my push bike would this have any negative effect on my insurance for my cars and motorbikes in the future? 2.) When riding my push bike through Bradford it’s almost a certainty that I will be involved in a RTA due to the poor car drivers. How could I claim from a motorist next time they knock me off? Could I purchase some form of cycle insurance that will fight a claim on my behalf? |

1/ Nope
2/ Yes you can get insurance, or make a claim against the driver yourself. -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!

1. I would not think so, typically insurers ask about previous claims on your motor policy, or accidents when driving your car, not other accidents.
2. A helmet cam seems the best bet at capturing the car number and establishing liability. A cycle policy will cover you for public liability, accidental damage and personal injury. No doubt if they can see the possibility of a claim against a third party they will consider pursuing it. LINK -------------------- |

How is it a hit and run on your behalf? You said he hit you??
Did you get any of his details? Did you report the accident to the police? Did you report an attempt of assult to the police? |

This case shows why it is important for cyclists to be insured:

How is it a hit and run on your behalf? You said he hit you?? Did you get any of his details? Did you report the accident to the police? Is there a requirement for a pedal cycle to stop following an accident or report it to the police? IMO not, as S170 doesn't seem to cover this at all, from either parties point of view. Guessing there is a careless driving argument to this, but if details weren't exchanged at scene I don't think this is an angle that can be pursued. You appear to constantly refer to this as if it was your fault.

Could I purchase some form of cycle insurance that will fight a claim on my behalf? Get a helmet cam so you can capture number plates. Then you can claim off their insurance or, if they're uninsured, you can claim against the MiB. -------------------- If you would like assistance with a penalty charge notice, please post a thread on https://www.ftla.uk/index.php

I joined British Cycling to both get liability insurance and to support a (IMO) worthwhile organisation - https://www.britishcycling.org.uk/membership I’ve dealt with them a few times - I’ve refused to act because they don’t pay market rates (for insurance work). Always bear in mind with insurance that covers legal fees that you will often get what your insurance company pays for. -------------------- Moderator

Fortunately I've not needed to explore the 'benefits' of their insurance cover thus far despite the best efforts of countless drivers to take me out.... Hope I've not just tempted fate! |
