A parking charge was issued for parking in hospital in a parking bay not for disable drivers
No disable bays were available at the time Blue badge was displayed Terms and conditions displayed, Blue badge holders only in disable bays. Need you help |

First step is to go to PALS at the hospital, mention the equality act (if they provide free parking for BB holders, they must make the same reasonable accommodation (whether they have run out of parking bays or not) also mention that government guidance specifically prohibits penalising genuine patients.

What sort of bay was it?

The only sensible interpretation of "Blue badge holders only in disabled bays" is "only blue badge holders are are allowed in disabled bays". Seeing it as "Blue badge holders not allowed in normal bays" would be perverse. Are you sure that's why the driver was ticketed?

I was assuming (not always a good idea) that the disabled bays (for BB holders) were free and the other pay (somehow), as the OP had a BB he didn't pay. Of course that could be all wrong.

Need OP to confirm exactly why the ticket was issued. Private car parks rarely give any concessions to BB holders (other than bays).

So what are the conditions of parking for those using the disabled bays?
One of my local hospitals requires BB holders to pay £2 (the minimum charge) for all day. The other hospital is free for BB holders but you must register at reception before you leave. |

Is there a required percentage for the company to provide disable bays for example 2% of the numbers of parking spaces ?
On my ticket there is the time seen 15:31 and issue time 15:43 which gives only 12 minutes to a normal person to get buy a ticket, how long does it take a disable person to do the same ? Don't know how to supply signage and can someone tell me what is PALS please |

PALS = Patient Advice and Liaison Service. Every hospital should have one.
The time seen is the first time the warden noticed the car in breach and they waited 12 minutes to issue the ticket You take a photo of the signage and post it on here or a photo hosting site such as imgur and link it to here. |

If the parking was free, why is this relevant ? Did the driver pay but delayed or did he/she rely on the Blue Badge to be exempt ? What were the terms and conditions - park in the disabled bay and display the badge or, in addition, register the car ? It won't help an appeal but I see a possible defence to a court claim that the operation is not in accordance with Best Practice as described in the NHS 07-03 Technical Memorandum for hospital parking It says that, in view of the uncertain nature of hospital appointments, motorists cannot know how long they will stay Parking should therefore be pay on exit |

This is what it says at my local hospital.

In the text I can't read at the bottom of that sign does it mention anything at all about UKPC?
Are you suggesting that there are 2 different parking companies on site, UKPC and this Legion Group? I presume so far that this is only a windscreen ticket and noting in the post. |

I think that post has nothing to do with the OP’s case. Only the terms at the material car park matter - there’s no universal standard! (Even for hospitals)
