Could you guys please help with advise
Along with a PCN fine (in a separate thread) I have received a post from Nottingham Police for apparently doing 43mph on a 30mph road at 00:03 on 14.Apr.18 This took place on A610 Nuthall Road, Nottingham (Between Bar Lane & Broxstowe Lane) My question is, do I have any ground to appeal any of these fines? I already have previous speeding conviction a few years ago and I've also taken the Speed Awareness Course just under 2 years ago which I means I would not be eligible to take another on. You really need to split the two incidents into separate threads. I suggest you create a new thread in the "Council..." forum for the bus lane PCN. And then delete the PCN stuff from this thread.
Otherwise this thread will get very confusing. |

Yes I was the driver at the time. Is there no other way to avoid getting the points and/or fine? The only way would be to ignore the fixed penalty offered and allow it to go to court. At court you would have to plead not guilty convince the court of your innocence. It's possible: - that the signage for the limit was incorrect - the Traffic Regulation Order has an error - you were not speeding but the equipment was faulty However it's very unlikely that any of the above is true and that accepting the fixed penalty is the cheapest option. Lose at court and the fine will be much higher and costs will be awarded. |

However I bumped into this site that helps with these sort of issues. So the whole creating post for advise on how to appeal these situation is all new to me Yes I was the driver at the time. You can't 'appeal' the speeding case, what you need is a defence in court, its rare for the Police to drop cases where any sort of appeal for clemency is made and they will send it to court to decide your guilt or otherwise.
If they were that easy to contest as you seem to want, no-one would ever be convicted, unlike PCN where procedural errors often result in the PCNs being overturned, as this is a criminal offence that rarely is an issue, the court will only consider if you are guilty or not. -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!
