Vehicle was parked outside a row of shops in Bramhall, Stockport. ANPR took a picture of the vehicle arriving and leaving.

Received a PCN which I have included a link to pictures of.

The location is 'land at 34-38 Woodford Road' does this mean the vehicle didn't have to be in a bay? The reason I ask this is because it is a road, there is no evidence the vehicle was in a bay.

In your opinion is it advisable to appeal? The amount goes up from £60 to £100 in 2 days
What can I include in an appeal letter?
Who do I appeal to, Civil Enforcement Ltd or POPLA?

I can provide pictures of the signage if you think it would help you give me advice.

Any advice is appreciated.

You can't appeal to POPLA untill you have appealed to CEL and they have given you a code.

It does help to get all the information and signs would be a help. The alleged breach is failing to pay so the use of bays is irrelevant, though there are bays marked.. I believe this is a private road and therefore can be subject to parking charges. You have deleted the dates on the notive, which can be helpful, and a copy if the reverse is needed as the front does not give any keeper liability.

My memory says this place has been the subject of a previous thread.

Thanks for the reply. The date is on the front - 23/06/18 and the back of the notice is on that link, you can find it if you scroll down.

I think it is a private road too, is it not worth appealing?

Didn't scroll down, sorry. Need all dates to determine if delivered within 14 days of event. Was it? Probably.

The requirements of the POFA seem o be on the reverse and seem to be in order, apart from period of parking. Here's POFA, run through paragraph 9 yourself to check

Very well known location

Poor signs and looks like a public road

In my view it's not relevant land in accordance with POFA because the Road Traffic Enactments apply

Yes, it was received within 14 days.

The box junctions that you can just see at the left and right is where the vehicle has been pictured.

I will go to the location later and upload a picture of the signs.

Relevant land:
(1)In this Schedule “relevant land” means any land (including land above or below ground level) other than—
(a)a highway maintainable at the public expense (within the meaning of section 329(1) of the Highways Act 1980);
(b)a parking place which is provided or controlled by a traffic authority;
©any land (not falling within paragraph (a) or (b)) on which the parking of a vehicle is subject to statutory control.

Do you think I could I argue it is (a)?

It is probably not a highway but is owned by the properties adjacent to it. Worth checking though with the local council.

Here's a more recent view, with the back of some signs showing.

Check for another thread at that location and see what they found.
