QUOTE (Redivi @ Sat, 29 Sep 2018 - 02:14) *
Yes

The Press has got worked up about the wrong scandal

For most of us it doesn't make sense to defend a case, regardless of the strength of our position

Even if successful it means taking a day off work
If unsuccessful, the costs vastly exceed the penalties

The police can therefore send NIPs unlawfully by second class post knowing that nobody but the very rich is in a position to contest them
Usually they arrive within 14 days and nobody even notices
On this occasion they were caught

But AIUI there was no suggestion that the Beckham NIP was sent 2nd class. The defence simply managed to find two examples of 2nd class to cast doubt on the infalibility of the system.

I’m sure some politician is thinking “hmm, it’ll be popular to remove the NIP requirement”.

At the same time may as well do away with technicalities like cautions and search warrants

Wouldn't be surprised to see moves to extend the deadline to four weeks
The Law of Unintended Consequences will then ensure that the courts are full of husband-wife S172 cases when they can't remember who was driving on a routine journey four weeks previously

If that's a step too far, abolish solicitors completely for motoring cases because it puts defendants at an advantage
The capping of recoverable solicitor costs has already gone some way down this route

I'd say that the UK is becoming a bit of a police state.
The police seem to be out of control, with politicians overturning centuries of public freedoms.
I'm a fan of Crimebodge (Rob Warner) on Youtube. See what you think:

Time to switch my dashcam sound recording on again now my wife has forgotten it

The Mail reader comments on the Beckham case are fascinating

Anyone who tries to give a rational explanation of the Law gets a lot of red flags

If you follow the comments to their logical conclusion, anyone who breaks the speed limit should send in his licence and payment whether he was caught or not

I haven't read the Mail comments but no doubt they are similar to the ones on Twitter. I dont know how many times I have tried to educate some of these brain dead folk about the 14 day limit . It's a losing battle!!

When The Mail reports DB had got off the charge because he hadn't received his FINE in time, there is no hope for their readers...

Where did Nick Freeman get hold of two NIP envelopes sent second class and signed by Sylvia ?

Given that long list of marques that seank listed in his earlier post as being represented by his Company, possibly from them.

How hard did your team have to look because it would be interesting to know the proportion of NIPs that are invalid for this reason ?

unfortunately social media, allows the window licking mouth breathers, who should have been drowned at birth, the opportunty to be manipulated, by self aggrandassizing (sic) media heroes, who now appear to populate the twittersphere etc. there is no critical thought anymore. what is worse is how the original media now just go clickbait. oh its clickbait, lets chase clickbait.

WTF?

I can only say that we responded to false claims by the Police units. Sorry, no further detail would be acceptable as we'd be accused of inciting the perversion of the course of justice.
If you read between the lines, I've just told you, really.
The police furnished 3 witnesses. Sylvia was the main one. It was clear that she'd only worked in the public sector, safe from whatever claims she made being defended by the state, rather than being accountable.
Our postroom staff are highly experienced and meticulous. To tell lies (maybe be mistaken) that ALL NIPs were posted first class was asking for trouble. Caron went to town and gave details that Sylvia's comments were just plain false. She could have given the exact number, but the lady judge could see what was coming and steered the discussion away.

It's all a bit upsetting. I've had discussions here about some posters advising folks to "roll over" when the reality is that the Police try any trick in the book to secure a conviction, just as in this case.

I just want to add that NF really is a first-class lawyer. Excellent skills in presentation.
This was a long hearing. Just over 5 hours, but he never faltered.
Sylvia was drawn in, because he asked her questions he already knew the answers to. The Nips were classics. I could imagine sitting there with a large box of popcorn, waiting for Sylvia to respond and then be caught out. It was good to see, but probably unprofessional.
Caron glared at Sylvia but there was no need, she was caught in her own web.
We get around 3 to 5 of these NIPs per week and Sylvia says her team sends out 3500 per month. A massive money maker, by any measure.

It was completely professional

A good lawyer doesn't ask a question in Court unless he already knows the answer

No, I meant it was unprofessional of me to find it rather funny.
NF really is very, very good. He forgot nothing, but didn't seem to refer to his notes much. He's looking rather old now. Age hasn't helped him. He must have been extremely sharp some years ago.
The Nip woman was destroyed, in a packed court, and she knew it. There was another administrator from the Nip Team, but NF gave her short shrift. He concentrated on Sylvia. My God, did he?
As a downside to all this, DB was Nip'd 2 days from this Nip in our vehicle and we have to go through it all again, but we can't help this time, so I'm not involved.

To be specific, a totting up ban for reaching 12 points

The magistrate wasn't impressed with the reason given not to ban
Needed his car for the school run

‘the former Manchester United midfielder had "no recollection of the day in question or this particular incident".’
Is that because he does it a lot like the guy who wanted to know exactly where he chucked his fag out the window.

Brings to mind previous articles where footballers/celebrities used a plea to say they couldn’t rely on public transport due to their ‘high profile’. Like they couldn’t afford a taxi!
