parking eye pcn, broken down in car park

Hi all.... have just received a pcn from parking eye, issued on 12/04/17, after staying in the carpark for 2 hrs 52 mins. this was due to the fact the car broke down and it took the recovery vehicle time to tow the car away. i went to see the manager who said they couldn't quash the pcn even though i took a copy of the store receipt and the manager stated that if i contact PE they would cancel the pcn. Would you suggest i appeal enclosing proof that he was using the store and also proof from the garage that they had towed his car. Also do you admit who was driving the vehicle?

Did they supply photo's? (i.e. the car being towed?)

yes they were photos and although you can see the tow vehicle you can't tell its being towed

How many checks was it that PE perform rolleyes.gif to prevent incorrect issue of a PCN?

No need to name the driver, just that the driver was shopping and here's the receipts, and also include the charge for the tow truck. Call it frustration of contract. And mention that they can see the tow truck in their own photos.

That shop manager must live in cloud cuckoo land! Which store was it?

Suggest an edit to the first post so that the identity of the driver cannot be inferred.

Aldi was the shop, she said that if i have any more problems with parking eye(which i think i will) to come back and she would raise it with the area manager

State it is unacceptable that THEIR AGENT has accessed your PERSONAL informaiton when there is clear evidence, in their agents photos, that the vehicle was being towed. Require them to cancel it.

Point out you will not be shopping there again unless this happens.

You can appela to PE and point out that, as their "up to 19 checks" including a supposed manual check has clearly failed, they have breached their obligations under both the KADOE contract AND the Data Protection Act 1998, and that you expect them to immediately cancel the charge and to cease processing your data. You include a copy of the tow charge receipt confirming the vehicle was towed. If they fail to cease processing yoru data, you reserve the right to puruse them for breach of the data proteciton act.

I presume it was another case of a threat of a claim for breach of the DPA that played this one out.
