In 3 weeks I move abroad - to Japan for a year but just received conditional offer from the police for my 38/30 which is 3 point + 100gbp fine.

Now here comes more trouble - misplaced somewhere my license recently and therefore just sent D2 form to dvla asking for issuing a new one, but honestly no idea if they will as I didn't send them my passport (will need it quite soon) and only attached p45 from my previous address plus old photocard license from same previous address found during searching for lost one (didn't know I still have it but my place is not the tidiest one) plus short letter explaining situation. Also attached new photo as the old one was about to expire in 3 months. Apart from passport I don't posses any form of ID at the moment (excluding cpc and digi card - hgv1 driver) so really had no other choice, sent it with next day delivery and now waiting how they're gonna look at it.

So coming back to police - condition for receiving 3 points and 100 fine is surrending driving license but that's quite impossible in current circumstances.

Any idea what my options could be in this siutation?

Not sure what advice you are after. Due to the UK's illogical inability to remove paper-only driving licences you still need to surrender your licence, even if you only have a photocard, to accept a fixed penalty.

If you wait for the maximum period to accept a fixed penalty and the glacial cogs at the DVLA have not posted you a new licence you can should return the form to the police with the covering letter and hope whatever socially failed human offers a solution.

Depending on the paperwork you have, you should always return any S172 request to name driver. Some forces combine this with a fixed penalty notice.

Where you are moving too and for how long dictates whether you are likely to care about any eventual conviction here. A conviction and points will not bother you if you are moving to Peru for a decade.

The current advice from the DVLA is:

"If you apply online, you should receive your driving licence or vehicle documents within 10 days (it can take between 6-8 weeks if you post your applications to us)."

In some recent dealings with DVLA, I was amazed how quickly they were turning stuff around, within a few days rather than weeks.

What you do can do with the passport is take a copy and get a solicitor or JP to certify it to be a true copy, and send that. take a couple of copies in fact and keep one separately from the original when you are in Japan, it helps if you happen to lose the original.

Me too, when my daughter bought a car in August, we got the V5 in her name within 10 days of the purchase.

If the licence was due to expire in 3 months time, could you not just apply for a renewal online? No need to send off your passport then, you just enter your passport number in for them to obtain the most recent photo.

I think mine took about a week to come through.

Funnily enough, this has just reminded me. I never did return my old licence...

Thank you for submitting your driving licence application online.

Your driving licence application has been submitted for validation checks. The driving licence should arrive in the post within 2 weeks.

If you are still in possession of your old driving licence, cut into two and return it to:

DVLA, Swansea SA99 1ZW

Please print this page or make a note of the application reference number in case you have a query. You can use your application reference number to check the progress of your application at www.gov.uk/track-your-driving-licence-application.
