HELLO CAN ANYONE HELP.
I WAS GIVEN A PARKING TICKET FOR PARKING IN A PARKING BAY-MARKED WITH BROKEN WHITE LINES. THERE IS RESTRICTED PARKING FOR AN HOUR.I CAM OUT OF THE SHOP AFTER =45 MINUTES AND HAD RECEIVED A TICKET FOR PARKING ON OR NEAR TO A BUS STOP.
I HAD NOT REALISED THERE WAS A BUS STOP AS THE AREA IS BIG ENOUGH FOR ABOUT 10 CARS AND THERE WERE CARS PARKED THERE ALREADY, AND I JUST PARKED IN A SPACE. THERE IS A POLE NEAR TO WHERE I PARKED BUT NO INDICATION AS THE SMALL TIMETABLE(METAL) WAS FACED AWAY FROM THE ROAD TOWARDS THE SHOPS. THERE IS A BUS NUMBER SIGN AT THE TOP OF THE POLE, BUT DRIVING UP I DID NOT NOTICE THIS. THERE ARE NO LINES ON THE ROAD TO SAY A BUS STOP IS THERE-WHEREAS LOOKING ROUND THE AREA AT OTHER BUS STOPS ,WHERE THERE ARE NO YELLOW LINES AT THE BUS STOP IT IS MARKED SO A DRIVER WOULD BE AWARE AND NOT PARK THERE.
MY ARGUMENT IS, APART FROM THE FACT THERE WAS NO INDICATION ON THE ROAD, HOW LONG IS A BUS? WHERE ARE YOU SUPPOSED TO PARK-THE BAYS ARE NOT MARKED, IT IS JUST A LONG PARKING BAY.HOW WOULD WE KNOW WHERE THE BUS STOPPED-BEFORE THE POLE, AFTER THE POLE??
WHEN I RETURNED TO MY CAR THERE WAS ANOTHER CAR PARKED NEXT TO ME WHO DID NOT RECEIVE A TICKET AND HAD BEEN PARKED THE SAME TIME AS ME.
SINCE THEN THE AREA HAS BEEN BLASTED AND RE-TARMACCED AS THE AREA WAS BEING PREPARED FOR RE-SURFACING-I TOOK SOME PHOTOS AT THE TIME OF THE TICKET ISSUE AND AFTERWARDS.
PLEASE COULD ANYONE GIVE ME SOME ADVICE AS I WANT TO FIGHT THE TICKET-AS I WAS NOT CAUSING AN OBSTRUCTION.
THANKYOU

It appears to be parked on graffiti.

I'd agree at the moment Dave but we're not being told about any signs that might have been around and confuse the issue. Looks good so far though.

it is so great for you all to help-I couldn't find anything about bus stops-at the moment all our town centre is being renovated and upgraded-loads of building work , and the car parks are very limited-basically there is no-where to park, but the traffic wardens are out in their thousands!!!so everyone in Urmston is fuming about the parking and the amount of tickets being issued!!

You're doing fine - a lot better than the 'post and go' brigade. If i was rude earlier it was only cos your font gave me a bloody headache!

can you confirm there were no signs at all apart from the bus stop? No smallish lates on lamp posts?

I'm torn at the moment whether you should make an immediate informal challenge or get a look at the TRO. They are not absolutely gauranteeig to extend the discount period but should't matter much since you apparently have a fairly strong case.
-
anyone's thoughts? Informal appeal or TRO first?

hi I didn't notice anything else-just a sign restricting the parking to one hour and no return within the hour I think?this sign was at the start of the bay-at the completion of double yellows, on a corner further up the road, but what is a TRO?thanks..

That sign is important. It sounds like it refers to the marked area (bay) your were parked in.

TRO is a Traffic Regulation Order. available by request or to view at Council offices - wherever they direct you - Town Hall?
some on-line but unlikely.
This will describe the actual intended restrictions at the location. Itwill be very specific about location so although a big document you only need to look at the bit you want.

Given that it is clearly not marked as a bus stop I would say you needn't do this. At the moment I'm thinking you should just make an informal challenge.

thanks for that-so do I challenge it on the grounds that it was not marker as a bus-stop?

Neil, you weren't rude, you were "horrid"! tongue.gif

Anyway, Nikkie, you need to appeal on the grounds that "The contravention as stated did not happen" as there were no bus stop markings. Their photographic evidence should back this up.

If they don't go for that right away (which would be stupid) then you will get them eventually.
