Hello

I would really appreciate if someone can help.
I received a SJNP for doing 53 mph on a 30 road. (A82 Near Carr's Corner Fort William).

I intend to please guilty by post (as the court hearing is in Fort William, Scotland - 6 hrs drive). In the SJNP that I received, it asks me to write to Procurator Fiscal Fort William using the Reply Form and envelope enclosed. However, the business reply envelope enclosed has address of Legal House in Glasgow rather than Fort William? Also, it asks me to send my driving licence using the attached guidance. The guidance on separate letter asks me to send my driving licence by registered post or recorded delivery to Clerk of Court.

I am not sure whether to send my driving licence along with the reply form and statement of means form in the envelope enclosed to same address (National Print Unit, Legal House, Glasgow). Also, Since the enclosed envelope is prepaid business reply envelope, I am not sure how I can send it by recorded delivery.

Can i use my own special delivery envelope rather than one enclosed and which address should different forms and driving licence should be sent to ?

Sorry, if my questions do not make any sense. Feeling bit stressed.

Do you really have a SJNP (presumably you mean Single Justice Procedure Notice), or a citation?

If you have a return envelope use that.

Little point using recorded or signed for, its no less likely to get lost.

Thanks for your reply. Will use the enclosed envelope then. Actually I looked at it again and it does say "Citation" on top of the letter, so not a Single Justice Procedure Notice. Sorry for the confusion.

Would appreciate anyone's opinion on whether I will get a driving disqualification for 7 to 56 days or 6 points (along with fine of course). This is for a driving at 53 mph on a 30 road (A82) in Dec 2019. The summary of evidence says: Traffic Flow: light, Visibility: good; daylight; road lit , Weather: dry

I have already got 3 points on my licence (SP30 - 76mph on a 60 road from Nov 2017 - wasn't offered a Speed awareness course - just £100 fine + 3 points)

There aren’t any sentencing guidelines in Scotland, although as you get one third discount on the ‘licence penalty’ with an early guilty plea, so it’s impossible to say with certainty, but as a fixed penalty is squally offered to 50mph a disqualification is unlikely.

If the court decides to consider a disqualification they will require you to attend for sentencing.

An SJPN isn’t an option is Scotland, England and Wales only.

If that offence was also in Scotland a course was not an option, they are not yet available in Scotland.

I finally received a fine from the court £130 and 3 penalty points.
It says that the "The sentence imposed was discounted in terms of section 196 of Criminal Procedure Scotland Act 1995 and would have otherwise been £180 and 4 penalty points."
