Hi All,

Received this PCN yesterday for being parked in a disabled bay without displaying a badge, but i was actually dropping off the badge holder and was escorting her into her home. The bay is outside her house and she had taken the badge in with her as she was not going to be travelling in my car anymore that day. I would say at a guess that it took about 5 minutes? to walk her to her door and help her in etc. I have viewed the images online and it shows 5 pics from 15.47 to 15.48. Do you think this is reasonable grounds to appeal in the first instance? I also note there is no observation period on the PCN and whilst in general i gather none is needed for this contravention, in the London Councils Civil Enforcement Officers Handbook it states the following:

CODE: 40
Penalty charge level: Higher
Code description: Parked in a designated disabled person’s parking place without displaying a valid disabled person’s badge in the prescribed manner.
Code contravention: The contravention occurs when a vehicle waits in a disabled person’s parking place without displaying a valid disabled person’s parking badge and/or clock.
Extra information to be recorded: •Details of any out of date or invalid badges Details of the Blue Badge clock, if appropriate, including the time being displayed.
Loading/unloading allowed: Yes
Observation period: Yes
Exemptions: ADEH1IJKNP
Suffixes: n = red route

I have asked for a move to the council section.

You have a good case for an exempt activity, the key one being alighting but taking only the time needed to ensure disabled person was safely 'delivered'.

Their photos pl.

I can see a Blenheim Gardens, Wembley on GSV, but no disabled bay ‘o/s 1’.

Assuming one’s there, of course the CEO issued a PCN, you were parked in the bay without displaying the necessary badge.

We just need to help you compose a challenge giving the authority the full story at the first attempt, so pl don’t go off half-cock but just fill in the gaps.

It seems to allow a boarding and alighting exemption:-

(e) provide that certain vehicles may wait in the parking places in certain circumstances, e.g., to allow persons to board or alight (maximum 2 minutes), to load or unload (maximum 20 minutes), etc;
