I would be very grateful for any advice regarding a SJPN I have received in Feb '20

Charges:
- August '19 Speeding 38mph on 30mph road
- October '19 Failed to provide information relating to identification of the driver


I don't remember conducting the offence. But a camera seems to have recorded the above.
Address the initial NIP sent to was getting refurbished so all letters have been collected and left to one side by builders away from my attention.
Shocked to receive SJPN. Found stack of unopened letters, left by builders including original NIP and NIP reminder.

Amongst the stack of unopened letters, I received another NIP and NIP reminder for a separate offence which took place October '19 (36mph on 30mph road). I expect to receive a SJPN for this in the near future.

Currently undergoing extensive training programme at work which includes vigorous assessments and exam preparation so have been extremely stressed and experiencing burnout - hence have not been mindful of letters.


What are my options and likely outcomes?
Can I take the points without paying a significant fine?
Will they consider the 'human' factors involved in this case?

I can't get to work without being able to drive

Plead NOT GUILTY to both, right now they have no evidence as to who was driving anyway, however once your case goes to the magistrates court hearing it’s a relatively simple matter to agree with the prosecutor that you’ll plead guilty to the speeding if they drop the (more onerous in terms of points, fine and impact in insurance) S172 offence.

And, in future - you cannot leave your arrangements like that. Always going to end in trouble.

The "deal" noted above has been done multiple times before. You can research this.

He can do the driving if he was (probably) the driver.

Should I reply to the NIP of the second offence now that I have the letter, even though the 28 days have elapsed (offence date 3/10/19, letter dated 8/10/19), or should I wait for a SJPN to come through for that?

It's probably too late to avoid the SJPN anyway so you might as well just wait it out.

On the online plead form, what is recommended that I write in the white box for:

1) Why I believe I am not guilty
2) Do you disagree with any evidence from a witness statement in the notice we sent to you? (Yes/No)

For both charges.
