Man is let off drink driving conviction for being too drunk to give a specimen..

The radio carried this story today for their phone-in http://www.lincolnshirelive.co.uk/news/loc...roviding-803675

..but they declined to go into detail on the reasoning behind why the judge thought it was an acceptable excuse.

(Right after, the news had a piece on how a forensic testing lab in Manchester has allegedly screwed up tens of thousands of tests, rendering them subject to tampering.. I wondered if the two were related)

I also wondered, if the opinion of a couple of police officers is sufficient to convict for various offences, how come this guy wasn't found guilty on the evidence that was obtained? (more than one officer deems him drunk in charge, a preliminary test reveals it is clearly the case..).. A case of incorrect offence charged perhaps?

It sounds like it..... I always thought the failing to provide a specimen charge was in place to catch drink drivers who were too ****** or stroppy to cooperate.
Seems like a happy drunk who tries can get away with it ????
