The PACE witness statement first appeared on this FightBack forum exactly one year ago today (Jones v dpp thread 8th February 2004) and, to date, we are not ware of anyone who has been convicted of an offence.
The first case that came to court as an S 172 prosecution, was mysteriously dropped by the Crown, at the last minute. Furthermore, the first speeding prosecution that we are aware of, did not proceed either and the defendant’s legal aid funded specialist in criminal law, has apparently taken to the PACE argument “like a duck to water”. -------------------- Regards, Mika
