NTO served without PCN being issued, I received a NTO in the mail but did not have PCN on my car

Hi all,

I received an NTO (served by civil enforcement officer HF345) on 13/12/2020 at 15:35. The NTO was served on 26/01/2021. However, I did not receive a PCN in the first instance.

The contravention - Parked in a residents' or shared use parking place or zone without a valid virtual permit or clearly displaying a valid physical permit or voucher or pay and display ticket issued for that place where required etc etc.

No pictures have been provided.

Thoughts?

Post the NTO.

What's the story - did you drive away or did you just find no PCN on the car - it's not unusual for them to go missing.

So no pics on council site?

If the PCN was correctly served then at least you can ask for the discount back.

Redacted NTO attached.

I didn't see any ticket inspectors at all. I stopped off for a few mins, was always within eyeshot of my car, and then got back in and drove off.

If no PCN was served on the car or to you then the NTO is invalid. They had the option to serve a postal PCN for a driveaway but did not do so.

You've checked there are no pics I take it.

Representation then is simple but wait for others who may have other questions.

Please note that no PCN was served on the car or to me at the time and location on the notice to owner so the NTO is invalid and must be cancelled. I was in view of the car at the time of the alleged contravention and there was no service of a PCN and no presence I could see of a civil enforcement officer.

I look forward to your early confirmation.

Re pics - it doesn't say anywhere on the NTO that pics are available to view.

Okay, I think I know what happened here. I had paid for parking using the Ringo app (I have proof of this) but chose the incorrect car within the app (as there are a couple of cars registered on my Ringo app). Morally, I think I have a case. But I don't think I'd get very far with the council based on this argument. If anybody would like to tell me otherwise, please do.

FYI - in a previous post, i'd said that the car was within eyeshot the entire time. I got my dates confused .

you are correct. i went onto the council's website and had a look for the pics, which i found. and i can see a PCN on the car although it wasn't there by the time i'd returned to the vehicle. i had paid for 2 hours parking but for a different car. my fault and so i'll pay up. it's frustrating as i had paid for a ticket - just put the wrong reg..

There is nothing to lose by making reps and you might get the discount back. Did you challenge this one anyway?

I think Hammersmith has been know to let people off who have made this mistake with Ringgo as payment was made.

So write to the council explaining what happened. Many councils will let you off the first time you make this sort of mistake, but even if they don't, they'll almost certainly re-offer the discount, which would save you 50% of the penalty.
