Hi, I got a ticket for driving down a bus only street. The signage is unclear and you will see there is no demarcation that straight ahead of the junction is bus only.

There was a bus that went in front of me going the same way so view also hampered. I already sent an appeal which they've rejected where I questioned the signage they were referring to as unclear in PCN. As far as I could see I followed rectangular blue signs ordering to go straight ahead.

The response was the sign located far away near Oakfield Rd. Incidentally I did not pass this sign as I came from Station Road on the left.

I've written an appeal for adjudication but any help much appreciated!!

Hi HCA,
I was in the right lane. Did not see the road marking. It may have been covered by stationary traffic, really cannot remember.

The sign the EA stated I should have seen, I did not pass as I came from the very junction I received PCN at.

There was a sign saying End of Bus Lane so it makes sense that one could go straight ahead, especially with instructing sign.

Also, in the past vehicular traffic used to drive straight ahead. Evidently the Council have changed the rules!

So you've driven this route before. And the last time you drove it you went straight ahead?

Your main problem is that no-one has seen the video. So don't submit a full appeal before you do, otherwise it could make you look foolish.

For example:

if the video shows the lane and sign were clear!

What's plausible is that you approach in the left-hand lane, your attention is drawn to the nearest instruction, both traffic sign and road marking, which is to move right and merge with traffic possibly to your right. Your attention is then focused on your rear and side mirrors. Having executed the manoeuvre AND ONLY IF THE RIGHT-HAND TURN MARKING WAS OBSCURED what traffic signs await you once you've straightened up?

As far as I can see, nothing. The sign to which the authority refer is at too oblique an angle and you say you did not pass an advanced warning sign.

And talking of angles, this would be mine based loosely on what you've posted, but without the video??

And not a single reference to regs! The adj knows these but they don't know what happened, what you saw, how this affected your actions and the reasons why you acted as you did. IMO, this is the key.

I haven't driven here for a long time bit yes, before I went straight on. In fact, if you look on GSV at the lights, you will see another car is photographed going straight ahead, so many seem to be being caught out.

When I straightened up, it was not possible to see right sign on traffic light as a bus was alongside on left...

Appeal being lodged shortly as deadline tomorrow but will mention I've not been able to see video and actions as I recall

OP, pl understand. You just register your appeal. Simples.

You will see the authority's evidence before you have to submit your full appeal. This will include the video.

Different approaches

I decided to put emphasis on the sign you did see and act on than those you did not. I did not mention the end of bus lane sign for to see it you would be looking to the left and should have seen the blue must turn right arrow. If you argue you could not see the one on the left, what about the one on the right? I prefer that what signing there is confusing but your money your choice. Nothing i wrote could be contradicted by the CCTV. So whilst you may want to bring to the adjudicators attention that you have been unable to view it before appealing you have no legal right to be able to do so within the regs

Send me the PCN details and I'll double check for the video, sometimes it doesn't show up even though it is there and you need to know how to get it.
