I wrote something simple along the lines of:

As the owner of the vehicle ................. I received a reminder Letter Notice of Intended Prosecution on the 16th January 2012, concerning a previous letter sent19th of December 2011, which I have not received.

Due to the time lapsed, I would need to see photographic evidence of the incident to help identify who was driving the vehicle at that time.

straight to the point etc


However, since reading the good advice here, it seems they go for the jugular and up the anti and proceed with FtF which leads to more points and more likely huge court expenses.

It seems perhaps the best way to approach this - is fill out the form that I was driving to minimise the damage?

This is a first time for me in over 17 years of driving, they really go for you. eh!

Your other problem is that if this is a reminder you're likely past the 28 day deadline to name the driver based on the date of the original NIP. Do I read correctly that you never received the original one?

Correct - I didn't receive original - i've turned the house upside down! It was the reminder letter that spurred me into action.

So the NIP require i need to complete their form in the next 7 days (from the 16th January) and you're right its unlikely that the letter I sent today requesting for evidence of photographs will come back in time.

So basically - i have to admit the offence without seeing any evidence, if i don't i could receive 6 points?

Do they take the letter i wrote as correspondence towards the offence?

yes,

to add matters, the car gets photographed (a rare car) a fair bit and I am quite used to people "snapping" a photo - so in an evening flashes do happen. I am a careful driver and it would be more likely that i was driving, however - seeing the evidence is something i'm entitled to though...right? I have written a letter (not filling out the NIP form, and posted it to the TCJ to ask for photos to make a judgement.

or is this a bad idea?

Date you received the NIP: - 38 days after the offence
Location of offence (exact location as it appears on the NIP: important): - A3205 Swandon Way / Bridgend Rd E/B SW18 (5029)
Was the NIP addressed to you? - Yes
Was the NIP sent by first class post, second class or recorded delivery? - Not known
If your are not the Registered Keeper, what is your relationship to the vehicle? -
How many current points do you have? - 0
Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - Unsure if I was driving, only just received reminder letter about the NIP on the 16th. I want to ask for photographic evidence to attain who was driving.
