Hello,

my car has been towed away on 08.02.20 by Haringey Council around 16 Boyton Rd London N8 7BE and I retain it has constituted an excessive application of the contravention code 27

I cannot honestly fully agree with the PCN (cmon, the car is far from obstructing the full kerb space! plus there are no signs, lines and the water is almost covering the kerb limit making not that much evident the presence of the lowered verge ) and needless to say i am baffled when I try to figure out the reasons for them having carried out the towing

as you can see the car was not entirely blocking the lowered kerb

what's your advice on this case? what are my chance of successfully challenging it?

thanks

Rob

If that is it, it's not a crossing point or at least it wasn't in the earliest view I can see without parked cars, back in 2012. That there are parked cars later suggests it isn't.

but there are other DKs in the vicinity.

Hello,

i've been given only 1, the £130 PCN (that went down to £65 since i've paid the penalty the day after at the vehicle pound) for having parked over there.

i have not been given any PCN for the towing, to be honest, only the receipt for the £65+£200 payment to drive away the car on 09.02.20 from the vehicle pound.

if you go back the one you were a bit over looks to be for bin access but there is a ramp opposite, but surely isn't for a crossing.

There are clearly 2 PCN's on the car so you need to check with the council, you have only paid one but we need to know which one

the argument that the DK is not for one of the statutory purposes is about your only chance if there is not a muck up with the PCN's

Don’t get this. The photo’s shows 2 PCN’s as served in that parking place.
The RTRA 101A says the charges to pay are “any penalty charge payable in respect of the parking of the vehicle in the place from which it was removed,”
So why charged for only 1? Was the other PCN for parking somewhere else?

OP, let's start at the beginning pl.

On *** (date and time) I parked at the location.

I returned on ** and my car was missing. I discovered it had been removed to the council pound.

I recovered the vehicle on 9 Feb. and paid the relevant charges of £260 comprising £200 charge for the removal and £65 penalty charge.

On recovering my car I was given the PCN, a receipt for payment and information as to how to make representations (where is this, you have not posted these docs, you've only posted the PCN and receipt).
