PCN has now gone to bailiffs! Need Advice ASAP!

Hi There,

This is my first time posting.

It has got to desperation point that i need advice ASAP!!

This whole situation dates back from February'15 to June'15

I was renting a flat in Sheffield, whereby i was provided with my own parking space, included in the rent. This parking lot was controlled by Vehicle Control Services LTD.

In the period above i was 'given' a number a PCN's that related to me not displaying my parking permit. Throughout this time and speaking to other residents in the same complex. I was told, 'its fine they are private and aslong as you park in the right space. It should be registered to your car'.

No problem I thought. As of over 4 months ago, i no longer live at the address. In this time and whilst i was living at the flat. Reminders/threatening letters/CCJ were sent to a previous address (before the flat) i lived at.

Because these were not addressed my original fines were passed onto a company called DCBL (bailiffs). They over the recent xmas period came to the flat where the parking charges we given, but no one was in. Fortunately for me, i knew the people that had moved into my flat and when i went round to collect mail (after the bailiffs had been) which I hadn't given my forwarding address to yet. I noticed a letter with no address, just my name. All it said on it was my name, attendance 14:05 and to contact either of the 2 mobiles numbers given in regards to a high court matter.

This of course got me on my toes because at the time of reading it as i had no idea what it was about. Once i finally got through. It was DCBL trying to 'claim back' the charges that were owed. The amount is £2000!!

This is due to it being it passed onto them by Northampton County Court Business Centre. I called them and they gave me little to no information about the specifics of my 'charges' and told me to get in touch with the original company who are trying to claim the 'charges' back.

This is where i am at now. After speaking to Vehicle Control Services LTD. They have said that the debt has now been passed on to said Bailiffs. This is all due to me not displaying my parking permit. I said to them that it was human error that a couple of times i did not display it and does it matter as the specific parking space is registered to my number plate. Their reply was it doesn't matter.

At time of writing this i'm nearly inclined to accepting defeat unless someone can help.

The Bailiffs will tell you anything they can think of that might get you to part with your money especially now you have told them about the possibility of a set aside, if you get one they will earn nothing from you.

Go for the set aside this stops the bailiff action and resets the clock allowing you to defend the claim

There have been some good court wins lately with regards to residential parking claims have a read of this link

Given that some of the cases are "persuasive" it means that a well presented case can be constructed as to why the tickets should not have been issued and you have a good chance of success if you take and follow advice on here for putting your defence together.

Do not delay with the set aside this stops the bailiffs dead and buys you time to build a defended case.

Yes, but their contract is a distraction. It's your 'contract' that matters.

Get it set aside, do your groundwork, almost definitely win and then claim expenses.

Or give them £2k for trespassing on your property.

The OP's had nearly a week to check if there's a judgement or not

He paid a visit to the forum yesterday but hasn't posted an update

If he doesn't act promptly, the court may refuse the set aside

The bailiff is also still free to act and the matter (plus his car) may be taken out of his hands

Bear in mind that in Homeguard v Jopson the judge awarded Ms Jopson £2000 in costs. It seems that judges dont like parking companies trying it on when they have no real case.

Keep the door and your windows closed when bailiffs are outside your home take some legal advice via citizens advice bureau (CAB) or learn some advice from https://www.scottishtrustdeed.co.uk/trust_d...ebt_collectors/

Offering advice on bailiffs is always welcome here (although it's a real minefield, and there is one expert in particular who we usually refer people to), worth checking the date on the thread though!
