UKPC NO RESPONSE, No Response since 14/12/17

Hello,

Apologies if I have spammed but would appreciate if somebody could give a response, I received a PCN from UKPC in December 2017 for a parking contravention on private property. Long story short I provided driver details on the 14/12/17 via the website and I haven't had a response back since except an acknowledgement letter on 11/1/18 stating

"Thank you for your recent correspondence regarding the above parking charge. We acknowledge receipt, the contents of which have been noted"

Is the matter now closed? Is there a time frame up until where they can still chase up after if they haven't received payment from the driver? I have logged into the ukpc appeals website today with the pcn number and the vehicle image is still there so I assume the matter isn't closed as its been over 5 months since i gave driver details and had any response.

Any opinions would be great.

Any keeper’s liability should have ended when you gave them the driver’s details.

Keep the correspondence exchanged for six years just in case.

The driver was a member of staff who worked for my business who is no longer with us, so don't have any contact.

If you have provided a name and address then liability has passed to him/her. You should not hear anything as they only look in the direction that leads to someone parting with the readies.

That's what i thought too Pensioner, but im assuming it's not resolved because the pic of my car is still on ukpc portal, so assuming they haven't got the money from the driver & ticket is still open, ideally wanted to know if anybody knew what the legal time frame is that they have to contact me again and say something like "we were unable to contact the named driver you provided, you are liable" etc

Strictly speaking, if you have provided the name and a serviceable address for the driver, you are in the clear.

The time limit for pursuing a debt claim is six years. So, just in case the parking company turns its attention to you again, keep the correspondence for six years.

There are conditions - see Schedule 4 to the Protection of Freedoms Act 2012 - which must apply for the parking company to recover unpaid parking charges from the keeper. These include:-

"The first condition is that the creditor—

(a) has the right to enforce against the driver of the vehicle the requirement to pay the unpaid parking charges; but

(b) is unable to take steps to enforce that requirement against the driver because the creditor does not know both the name of the driver and a current address for service for the driver."

If it has no success with the driver, UKPC could return and try to recover payment on the grounds that he was an employee of the company

Was he on company business or was it a private journey out-of-hours ?

from what i can recall i think he just wanted to use my car to pop to the local shopping centre to pay in some money into his bank

No such time frame because they cannot do that. Keep your proof that you transferred liability, for 6 years from the parking event.
