Forgot to display bluebadge

Good Morning Everyone,

The driver went to Thegym at Derby and parked in a blue-badge bay and forgot to display their badge (I know silly) The driver remembered around 3mins later after getting ready in the changing rooms but by this time it was to late and they had a ticket/card stating Vehicle control had made a note of the vehicle (sorry I don't have the card to hand to give the full details)

My question is the driver just best off paying the charge once it comes through the post? Shall the driver email the email address on the card pictures of their bluebadge and hope it helps? Whats the best plan of action. If the driver has to pay the that's fine it's the drivers mistake at end of day but if they dont have too and there's an easy way round it that advice be great.

Neither, go back to the Gym and ask them to cancel for a genuine visitor, if needed remind them of the equality act and the need to make a reasonable adjustment, legally they need to provide a disabled bay whether you have a BB or not.

Meantime as you will deal with this as 'the keeper', EDIT that post so as not to give away what 'the driver' did, refer to them only as the driver, no I, they, she, the dog.

NEVER EVER phone a private parking company.

No such thing as a "blue badge bay" on private land, and by requirnig one they fall foul of those theyre required to provide spaces for that eitehr cannot eget a blue badge or simply dont want one. Thats discrimination. Suggest to the gym that they whitelist your vehicle, as otherwise they are in breach of the Equality Act 2010.


No, this is VCS. Noone bloody pays them. They are WOEFUL
What you do is
1) EDIT YOUR POST, NOW. No arguments. THE DRIVER parked and did not display a blue badge. THE DRIVER went inside and remembered within 3 monutes but... and so on. NOONE is told, here or otherwise, who is the driver. YOU are the keeper, YOU will be handling this as the keeper.

There is not an easy route as such - this company does do court, not for every ticket however. So you
1) Appeal that they failed to meet the mandatory grace periods at the start, required by the IPC Code of Practice.
1b) add that the driver held a valid blue badge but was retrieving it. As the driver has protected requirements, use of the space was authorised regardless of the display and failing to permit this is a breach of the Equality Act 2010, for which they and their employer are jointly and severally liable.
2) If this is the "not a PCN" notice to driver, then they will have failed to comply with POFA. Theyve infact been told to NOT use these "not a PCN" - so what do you have?

Then you ignroe debt colelctors, ignore the IAS service (you will lose) and see if they try court.

Dont pay them, please. Whiel youc an afford to, not everynoe can, and these people are scum.

Carried out my appeal last night for the PCN that came through the post. Does anyone know how long it normally takes for a reply? What happens if it's rejected?

Search the forum for VCS threads
Read ,and understand the parasites youre dealing with.

They WILL reject your appeal. Thats a given.

Hi all, i received the below email today on my appeal is it normal and where do i go from here? Sorry i cant find any other posts like it.

We refer to correspondence received from you concerning the above numbered Charge Notice.
Please note that responsibility for this Charge lies with the driver of the vehicle at the time the parking contravention
was observed. However, it appears from what you have stated in your appeal that you were not the driver on the
date in question.
In order for us to process your appeal correctly, please follow the instructions below:
1. Notify the driver of the vehicle that they will need to appeal to us directly, including their FULL NAME (Forename
and Surname) and a valid FULL SERVICEABLE ADDRESS within 14 days.
2. If you are representing the driver we require a signed and dated statement from the driver of the vehicle confirming
that you are authorised to appeal on his/her behalf; this needs to be an original signature and not a photocopy or a
stamp. The statement MUST contain the drivers FULL NAME (Forename and Surname) and a valid FULL
SERVICEABLE ADDRESS.

Yeah i went in and spoke to your manager. He said parking was nothing to do with the gym and they dont get involved with the company issuing parking tickets

Hmm is the gym on fscebook, or trip advisor?

A legall honest and truthful account on either of these of what has happened ( advising BB holders to be careful when parking there etc )sometimes produces a quick response from them.

Yeah they are on facebook its thegym group so its in like a littoe retail park with a few other shops around it. Whats the best advice about the drivers details they are chasing?

No the car park is nothing to do with the gym. The gym is just in a retail park and the car park is ran by a private parking company. The retail park is called Southgate Retail park at Derby if that helps?

What should happen, its that you should tell the parking company that an occupant of the vehicle had a disability as described under the equality act, add the haggling charge must now be cancelled.
If they do things right the charge should be cancelled.
However doing things right doesn't make money.
telling the parking company the above, even though it doesn't have much hope of success will help with future complaints and or actions you will need to take later

Where are you getting that strange idea from??

Tell the parking company an occupant of the vehicle has/had a disability ( protected characteristic) as outlined - they will reject, do not challenge this further to IAS
Then get in touch with CPS retail ( link in previous post) tell them that an occupant of the vehicle has /had a disability ( protected characteristic as covered by the equality act) and as such the driver used the reasonable adjustments made towards people with disability's ( disabled bay) however despite informing CPS retails agents of this, they are still pursuing thi matter , which could potentially be seen as a breach of the equality act by CPS retail through the actions of their agents
