Hi All,
I wondered if someone might be able to help me with the below at all please? I apparently went through a Bus Gate in Romford when visiting my terminally ill cousin in Queens Hospital. The first I knew about this was when I received the attached letter in the post. I had no knowledge of this before this letter, so had not received any other correspondence in relation to this incident. After goggling the contravention and looking on Google maps I can see it was a Bus Gate. I phoned, to no avail, and emailed the council to notify them of the situation and not receiving the first letter. They eventually responded that the case was on hold and I would receive further correspondence in the post. I have now had the other attached letter sent to me stating I need to pay the full £195 before I can do anything. On a Facebook page someone has advised me to submit an 'out of time witness statement' once I receive the order of recovery. After goggling it appears this is a form on the Gov.uk website. Can anyone clarify if this is what I should be doing? Do I need to do anything in the meantime as I'm concerned I don't want to be waiting to then be hit with more expense. I don't have £195 to pay up front to sort this, not I think I should as I never received the first letter. Any help would be greatly appreciated.

Just do as they say in the letter - wait for the order for recovery and then make a declaration that you didn't get the PCN.
This automatically cancels everything and the council will usually then reissue the PCN. Is the address correct on the charge certificate. See process: https://www.londontribunals.gov.uk/eat/unde...rcement-process |

Address correct on the Charge Certificate, yet the PCN, which would have been sent first to the same address was not received.
OP, have there been any problems before with mail delivery ? Anything that might have caused the original postal PCN to have gone astray ? Reason to ask, is that the Order for Recovery is also sent by mail, and you must receive this as when it is sent, a 28 day period is allowed for you to submit a Statutory Declaration. The form to do so is usually included with the OfR. The CC is dated 4th April, so it's now around the time they can register the debt at the TEC, Northampton, so they can issue an Order for Recovery. It is therefore important you keep a close eye on things and don't just wait around for the OfR. I would contact the council every week to find out if they have registered the debt yet. |
