Hello everyone,
I am looking for help in appealing a two PCNs that I believe to be invalid. They were both issued in Wandsworth borough and on the same parking spot. The contravention code is 01 (Parked on a yellow line or in a street where there is a temporary waiting restriction). The assertion is that the rear wheel of my motorcycle was on the yellow line on both occasion but I believe the pictures suggest otherwise. Any advise on how to approach my appeal would greatly appreciated. Kind Regards. |

I would make a complaint for the poor handling of the representation. I assume they will just issue an apology but fail to acknowledge any wrongdoing. The LGO would say you should have done better and tell them to say their sorry that's it. Is it worth the hassle ? I've been asking myself this. It's hassle for the council too, if everybody complained about all the sh*t rejections, there's a half chance they might get their act together. My submission:
Good afternoon, I was issued two PCNs which were subsequently overturned due to the fact that they were issued under the wrong contravention code. Initial appeals on both notices were dismissed and differing reasons were issued despite the identical nature of both violations. This points to a compromised understanding of parking regulations at both the enforcement and administrative level.This ordeal has caused undue stress I and as such I would suggest that PCN staff undergo regular training to ensure accuracy and consistency in the application of their duties. Response form Head of Parking Compliance: Thank you for your enquiry received on 1st October 2020 regarding the above Penalty Charge Notices (PCNs). As Head of Parking Compliance, your enquiry has been passed to me for reply. As you are aware the PCNs were issued because your vehicle was parked in a restricted street during prescribed hours. In your enquiry you state that both PCNs you were issued were of an identical nature but were both initially upheld but for different reasons. You further state that this points to a compromised understanding of parking regulations at both the enforcement and administrative level. I have investigated these two PCNs and the response that you received. I can confirm that the response to WAxxxxxxxx was incorrect and for this I apologise. The officer involved has been spoken with and this will be used as a training tool for them. I once again apologise for any inconvenience and can confirm that both PCNs have been cancelled. |
