My son has just recieved a PCN from NCP in Yorkshire with ANPR pictures of his car entering a car park and leaving 9 minutes later at 3.21 am.
He was picking up a friend who was in town Although im keen for my son to learn the lesson, im also angered by the demand of £100 or £60 if paid early. My question is.... He did pull into a car park and didnt pay for a ticket albeit for 9 minutes in the early hours Would he win with POPLA? The BPA Code of practice allows for a 10 minute grace period ( as does the IPC) if the time parked was as you state 9 minutes it falls into the grace period and NCP who, are bound by this so called code of practice shouldnt have even accesed your sons details via the DVLA and thengone on to use/process his data

I’ve actually seen the letter now, not posted in anger and taken a teenagers word for it. It’s 14 minutes so doesn’t fall under any grace period Appreciate the response anyway as I didn’t know that Given that, does anyone think he’s got a chance of winning via POPLA? Facts are... He entered the NCP car park at 3.21am waited for his friend for 14 minutes didn’t buy a ticket drive out Advice is always appreciated |

He is unlikely to win at POPLA using the grace period as he exceeded the 10 mins. I suggest that you post a redacted copy of the PCN on here for comment. There may be other angles you can use depending on how compliant the PCN is with POFA.
I also suggest that you remove the inference as to who was driving. Never admit to who was driving as that closes off some angles! Make the PPC work as hard as possible! You need to make them default to chasing the keeper not the driver. |

In which case wait for the NtK to land on his doormat. If it is non-cplisnt with POFA then it is an easy win. You must delete any mention of who the driver was. The PPCs look at these forums!

NTK in the post, para 9. You've hidden the dates, it could just be that it misses the 14 days for delivery using the assumed 2 days from posting.

OK so they could just have scraped in. The 14 days is the time till it is received. Posted on a Friday gives till the Tuesday for it to be delivered.

Oh come on, it's poxy NCP! I can't believe I am reading a poster on pepipoo actually saying they think they can't win against NCP!
No-one pays their PCNs, for the love of God this is nothing to worry about. You would be setting a terrible example to your son if you fall for this scam by paying it. So to have discovered the parking terms would have taken longer in the dark, because no signs would have been visible at all on arrival and without getting out of the car and getting up close with a phone as a torch!NCP normally back down when faced with the usual long POPLA appeal from a registered keeper.
