Hi,
I have received NIP for a speeding offence on 11th March 2020 for an speeding offence on 9th March . It was from a mobile unit and I was doing 43mph in a 30 mph zone ( Scotland ) . I had replied to the letter stating , that I was indeed the driver of the vehicle at the time of offence. I sent this letter on 29th March , by first class delivery( I had taken a picture of the signed NIP both front and back for my record ) . I was expecting a response from the police but so far I have not heard from them . I thought , the delay could be due to COVID -19 lockdown. However , it is just over 6 months since the Speeding offence occurred and I am still unsure what had happened . Going through various forums it was stated that police has 6 months to respond to reply for NIP sent back to them. As I have not not received any response from them I was concerned a) is it being sent to court hence no response from police b) 6 month rule doesn’t apply due to recent COVID and there is a possibility of receiving it still Or Police had forgotten me or misplaced my reply for NIP - I did not receive any reminders or correspondence Has anyone had gone through similar situation and what is the likely chance of me receiving a late response from the Police. Also should I contact the police with the reference number ( I was bit worried whether it would be a suicide mission of unnecessary revoking a dead lead) I would appreciate if you could shed some light and suggest to how I should approach this scenario Thank you All ! The 6 months statutory limit hasn't changed. You must as well try and contact them - either it's been processed for prosecution or not (where it's too late anyway).

The six months in which the police must commence prosecutions is from the date of the allayed offence, not from when they get your NIP response back. The law hasn’t been changed due to COVID, nor is there any dispensation from it under any circumstances (for the offences for which it applies).
However if they didn’t get your reply the offence of failing to furnish drivers details occurred on the 28th day from when you were served the NIP so hasn’t yet timed out. -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!

It might be worth checking your driving license online just to confirm you haven't missed any communication and they haven't added points to your license.

Assuming that the police had not received my reply , they should have sent me reminders and also a correspondence to state they are prosecuting by sending to court . So far I have not received any correspondence what so ever . Based on what you said in the last paragraph , is it correct that I must wait 6 months from the 28th day of Issuing NIP ,assuming that they didn't receive my reply . So far I have not received any correspondence what so ever Some forces do not send out reminders.They also often wait the full 6 months before commencing proceedings and up to that point they will be silent. Based on what you said in the last paragraph , is it correct that I must wait 6 months from the 28th day of Issuing NIP ,assuming that they didn't receive my reply . It could be even longer than that, the 6 months + 28 days isn't when they have needed ti inform you, but is the point where they need to start the process. Paperwork to you. may not arrive for a number of weeks later. |

Not sure where you get that idea, there is no 'should' at all, they don't have to send anything at all except the 'summons' (Single Justice Procedure Notice or a Citation for Scotland), the process for commencing proceedings doesn't have to start until just before the 6 months are up (so circa 7months and a week or so after the original alleged offence date). Even then that can take a week or 2 to arrive (so circa 8 months after the original offence date). MOST forces send reminders, but not all.
