Hello

Need some help please.
My son joined a gym which offer free 2 hours parking for members,On his first day he took my car and was suppose to enter the reg on the terminal inside which he didn't, there must have been signs but he was unmindful.Now i have received a letter from parking eye to pay a charge of £100 or £60 discounted.(ATTACHED)
The gym have said they cannot do anything and we should take it up with parking eye but so far what i have read is parking eye will reject the appeal.

can anyone advise please.

You've left the reference number in that picture

There may have been signs but not necessarily well-displayed
If he was a new member, the gym staff should have told him about the parking arrangements

Personally, I would be giving the gym seven days to choose whether to cancel the parking notice or my membership

It's pure gym Leicester, st George's tower, it's a shared building.
I talked to the gym and requested them to cancel it but they said they do not have any contract with parking eye therefore can't help but they will send me a appeal form to send to parking eye.

Don't actually understand how it all works personally. I'll see what the form is and post it on here.

I believe that this is the car park Strange that the sign at the entrance says "Private Car Park. No unauthorised parking"

Here what the web site says about the parking

Yes the sign is obvious , my son is not the brightest when it comes to being aware of these things.

But is it obvious if you don't know about it and it's your first visit. Is it in line of sight as you enter?

Not in the car park itself but When you enter into the reception they have a big stand banner regarding the parking.

But what do the signs say in the car park. If they repeat the no unauthorised parking signs then that is good for you.

I emailed the manager last week and have now received a reply.

"We unfortunately will not be able to cancel this fine and can only support you with providing a document. Please see attached this document and you will need to appeal directly with Parking Eye.May we wish you good luck with your appeal and we are sorry we cannot help with cancelling this fine". huh.gif



i have attached the document along with pics of the signs. so how should i go about the appeal?

Try that with PE. When they come back with a refusal, go back to the gym and demand that they instruct PE to cancel. They are the principal who brought in PE and are wholly responsible for the actions of their agent. It was the failure of their system that was the result of the PCN. Their inability to make sensible arrangements for their customers' parking will not besmirch your good name, nor cost you £100.

You may want to consider a 1 star on Trip Adviser and any other high profile gym rating forum. You may also like to get ready to involve the local press.

Point out you will be cancelling your membership if you dont get his cancelled, as being cahrged £100 for THEIR FAILURE is not something you included in your costs.
Or they could INSTRUCT their AGENT
If they cant do this, then their incompetence in hiring agents also gives you no confidence.

Ok I didn't explain the letter sorry my fault, So basically to enter the gym you enter your membership number on the gym pod then once inside you enter your car reg on another pod.(parking eye)
I don't know why they even mentioned it but theiy are saying their pod sometimes doesn't record the entry's into the gym, even the staff member said the same. So hence they are confirming the visit to the gym in the letter.

So technically it's not their fault according to them. So asking them to cancel which I already have wont work.

You are TELLING THEM TO CANCEL
They hired PE
They have the chance to cancel it, now, before you cancel your membership
THEY are responsible for their agents actions, and if they cannot instruct them to cancel, you require this in writing

This is the difficulty I'm facing , iv told them they cancel or I cancel they've said they do not have a contract with parking eye and the manager already has given me in writing on the email that they cannot get it cancelled. :angry

How much truth is in it I'll never know,
So If I appeal with the supporting letter but not mentioning driver would that be a good idea?

In that case, ask them to get on to whoever hired PE (who they will know), and get their help. You need to get this to a point where PG are so embarrassed about the system failure that they end up either getting cancellation of they pay it!

Meantime, subject to the thoughts of others, yes, send PG's note to P{E with a covering letter.

If they didnt bring in PE what is parking eyes signage and machine doing in THEIR place of business?

They want to fob you off. Dont let them. They will know exactly what the relationship is between them and the car park and PE. You need to be firm adn assertive and do't ask tell them you expect this cancelling or when it goes to court you will be issuing witness summons for them to attend and explain. That may get them moving.

SO who hired them and made them put PEs equipment on THEIR premises? Are they getting paid rent and utilities for PEs equipment?
Theyre talking rubbish
If youre not speaking with management then do so. Go national if you need to.
