NIP Details and Circumstances
What is the name of the Constabulary? -
Date of the offence: - October 2018
Date of the NIP: - 4 days after the offence
Date you received the NIP: - 8 days after the offence
Location of offence (exact location as it appears on the NIP: important): - M25 Epping, NR M/POST 5563A, Clockwise Carriageway
Was the NIP addressed to you? - No
Was the NIP sent by first class post, second class or recorded delivery? - Not known
If your are not the Registered Keeper, what is your relationship to the vehicle? - Company lease vehicle
How many current points do you have? - 0
Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - Driving from Nottingham to South East London. Spent most of the M1 in a roadworks 50mph zone, arrived on a quiet M25 and went far too quickly.

91mph in a 60mph zone.

I do not remember the gantry displaying any restriction. Though, still not an excuse for my speed.

New car, my first long run in the UK, significantly more powerful than my old car and got carried away.

My research suggests I am 1mph inside the Band C penalty. So should expect a magistrate court summons, a 150% penalty, 6 points and court costs. I hold my hands up, will drive like Cliff Richard going to church from now on, but would really appreciate guidance and support.

First offence of any kind.

NIP Wizard Responses
These were the responses used by the Wizard to arrive at its recommendation:
Have you received a NIP? - Yes
Are you the Registered Keeper of the vehicle concerned (is your name and address on the V5/V5C)? - No
Is the NIP addressed to you personally? - No

NIP Wizard Recommendation
Based on these responses the Wizard suggested that this course of action should be considered:
  • Do nothing!

The police are not requesting the information from you, they are requesting it from the person the NIP is addressed to.
Wait until you receive a NIP addressed to you personally, then come back here.

As you say, you are into Band C, therefore 150% of weekly net income, less 33% for a guilty plea, plus 10% surcharge (minimum £30), £85 costs, 6 points (although up to 56 days disqualification is possible)

The company should respond naming you, and then you get a NIP addressed to you. Wait for that. It may take some months before you hear from the court, and that is likely to be a single justice procedure notice. You cannot attend a single justice procedure, it is a postal process. The single justice may require you to attend a hearing before a full court for disqualification to be considered, 6 points would still be the likely outcome.

Update: I have received a Conditional Offer of Fixed Penalty. They offer £100 penalty and 3 points.

I have never been so pleased to get a penalty. This is considerably less than expected. Also, the idea of going to court is frightening.

I must add, if the purpose of penalties is to change behavior, then it works. I really have slowed down since going through this process.

Bite their hand off! biggrin.gif

Fixed penalties are usually offered only up to 85mph in a 60mph limit.
