NIP Details and Circumstances
What is the name of the Constabulary? - Date of the offence: - July 2018 Date of the NIP: - 84 days after the offence Date you received the NIP: - 87 days after the offence Location of offence (exact location as it appears on the NIP: important): - M6 Houghton Travelling South Was the NIP addressed to you? - Yes Was the NIP sent by first class post, second class or recorded delivery? - Second If your are not the Registered Keeper, what is your relationship to the vehicle? - How many current points do you have? - 0 Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - The day I bought the car drove it back down to London from Scotland. Was clocked at 80 in a 70. Honestly was messing around with cruise control and just didn't pay attention. Says 'manned equipment' It says I 'could' be offered a course but what are chances of this? NIP Wizard Responses These were the responses used by the Wizard to arrive at its recommendation: Have you received a NIP? - Yes Are you the Registered Keeper of the vehicle concerned (is your name and address on the V5/V5C)? - Yes Did the first NIP arrive within 14 days? - No Was there a valid reason for the NIP's late arrival? - Unsure Although you are the Registered Keeper, were you also the keeper of the vehicle concerned (the person normally responsible for it) at the time of the alleged offence? - No Were you driving? - Yes Which country did the alleged offence take place in? - England NIP Wizard Recommendation Based on these responses the Wizard suggested that this course of action should be considered:

Assuming you are eligible (i.e. haven't done a course in the last 3 years) then in England/Wales you will be offered one for that speed. ... you are only 1mph above the usual start of enforcement.
The only issue is you need to get your reply back quickly - course offers are time limited, usually about four months after the offence (to give time to start court proceedings if you don't attend the course) and you are already at three months. There is a valid reason for the NIP's late arrival, in that having just bought the car you were obviously not the registered keeper at that time, so the first NIP would have gone to the previous owner. As advised above get the reply off ASAP and cross your fingers, failing a course, you should get a fixed penalty.

There is a valid reason for the NIP's late arrival, in that having just bought the car you were obviously not the registered keeper at that time, so the first NIP would have gone to the previous owner. If we assume that the OP bought the car privately, that would be a very reasonable assumption. However, if the OP bought the car from a dealer, and if it was showing as being "in trade", then I would not suggest discounting the possibility of a late NIP defence. -------------------- Andy
Some people think that I make them feel stupid. To be fair, they deserve most of the credit. |
