dcblegal Formal Letter of Claim, How to Appeal

Afternoon all,

Apologies as I’m sure this has been discussed 100’s of time’s before, but I’m unfortunately at a point where I only have 12 days left to sort this.

In short I’ve been sent a formal letter of claim from dcblegal acting on behalf of Cp Plus Ltd stating I have 30 days to pay a £165 parking charge notice from 2015 at Wembley Stadium Retail Park. I spoke to Cp Plus when I received the notice and said I wasn’t paying the charge because their signage wasn’t clear and they backed down. I thought that was that

It’s a minefield of conflicting opinions on what should be done from ignoring the letter to appealing using one of many templates.

Could someone please just confirm what the best course of action is? I’m happy to send an appeals letter, but need to know which is the right one to use. £165 is a lot of money to be paying out in these current times and I certainly can’t afford to pay out more if it went to court and I had my pants pulled down.

Any advice would be massively appreciated.

What did you mean about them 'backing down'?

Because I basically said I wasn’t paying it they said as it was on private land they wouldn’t pursue it (or words to that effect). I’ve got no evidence of that.

It does say on the attached letters above I can propose an alternative method of resolution. I’m assuming that meant I can appeal.

So you ask dcblegal for copies of all the documents that they intend to rely on in court in order to minimize the differences between you, as expected by the courts.

As they are threatening court they must have these documents to hand and therefore you expect them by return or in any case within 7 days.

You send a SAR to the parking company requesting all documents they hold about you and your car

Ok, ask them to issue a POPLA code so the matter can be considered by an independent appeals service. (They won't oblige however)
