Do the Magistrates have the power to gather their own evidence during trial?
I claimed I had proof that the evidence being used against me (photo) was not the same as the unused evidence (video). The magistrates looked at the material and decided they were the same. They are wrong and didn't ask for my evidence. I thought magistrates weigh the evidence not gather or ignore it? Does anyone have any acts/cases I can cite for my appeal? Thanks! |

It is shame you didn't post on the forum before the hearing/trial. Have you been convicted of the alleged offence and if so what was punishment. This may help in deciding whether this case is worth fighting in the crown court.
I suspect you rejected the hearsay evidence for the opinion of the magistrates, in which case the police officer gave evidence under oath, which carries more weight than a piece of paper unsigned. It could have been argued that you felt you were disadvantage by the written evidence as it was inaccurate and thus you opted for not guilty. However, the evidence given in court may have been given favouring the prosecutions case. But the magistrates will only consider the evidence presented by the prosecution and the disclosure of any evidence that would have strengthened your case and any evidence you had to undermine the prosecutions case. I suspect you made a lot of mistakes in the magistrates, you now need to rectify those mistakes for a potential up and coming appeal.
