Hello all.. I am a new user and first time poster..
I would like some advice on whether or not I can appeal against a PCN that I received today (21/09/2018) through the post.. It is a PCN from Leeds City Council with regards to my vehicle been stopped in a bus stop.. I have not been given any photographic evidence to suggest my vehicle was in the said bus stop just the PCN... In their description it says: The PCN is being served by post because a CEO had begun to prepare the PCN but the vehicle was driven away from the place in which it was stationary before the CEO had finished preparing the PCN or served it. Even though the said CEO began preparing the PCN, should he'she have not had photographic evidence proving that my vehicle was parked there? And should that photographic evidence have been accompanied with the PCN that I received in the post? Pictures aren't needed - the CEO's the witness with their notes.

One question I have is what were you stopped in a bus stop for, assuming you were.
It comes down to the credibility of the reason for service of a postal PCN. For instance, if you stopped, passenger got out and you left...30 seconds maybe, CEO may have seen but started a PCN? Or at the other extreme, parked up while went shopping, easily credible. |

I was actually waiting outside my son's college for him, he is a VP (vulnerable person) and suffers with a condition called developmental co-ordination disorder. Too much to explain except that he can't be left in public by himself sohad to pick him up and as there is nowhere to park that was the nearest spot. As soon as he got in I drove off perhaps 2-3 minutes at the most. I never saw any CEO during that time.

We need to see the PCN as Leeds can have faults.
Put it on a site such as https://imgbb.com also post the Google Street View. Councils have duty to consider appeals and your situation should certainly be considered. If you don't appeal though you won't get the chance. The best approach is for us to look at the evidence and help you firm up a draft appeal. |

Here is the link showing the place where I picked up my son: https://ibb.co/bB3R2U The building is the college my son attends and the bus stop is where I picked him up, like I said I was there maybe 2-3 minutes.. He is a Vulnerable Person hence the reason for me been there otherwise I wouldn't have to need to stop there. Also a note to be made is that there is no where else to park without the need of a Permit.. There are plenty of parking spots around but those are for Permit holders only.. Have you asked the council if there are any photos? I haven't yet been in contact with the council. My first instinct was to see whether or not I can appeal as this was sent to my home address and not fixed to my windscreen. Obviously I drove off after picking up my son and it seems at the same time I was doing so, this CEO was taking down my details. But if it makes any difference which I doubt, I can contact the council and ask if there are any photographs. |

I've looked at link you posted and they do have pictures of my car in the area; just a minor contradictory is that on the PCN it says 14.51 but the pictures say 14.49... I will try to contact them a plead my case see if they will overturn the decision due to the circumstances... Many Thanks again for you reply.. |
