Brief history:
Offence 13/11/03 - 40mph in a 30 - Peel Way, Bury. Lancs [list]Received NIP in 2nd class envelope. Declined conditional offer of fixed penalty. Received Summons April 2004 Pleaded Not Guilty 1st Hearing June 2004 - Adjourned to set "real trial date" PTR July 2004 - Plead Not Guilty - Request CTO Clerk to attend Trial August 2004 - Adjourned because CTO Clerk is sick[list] Today we have the second trial date. CPS prosecutor requests another adjournment because the CTO Clerk is on holiday in Tenerife. I oppose the adjournment on the grounds that this case has been ongoing for over 12 months. Also this would be the second time they have applied for an adjournment because of the non-appearance of the CTO Clerk, though because of illness the first time was understandable. This time was not. The GMP Central Ticket Office had 4 months notice of the trial today and to allow a member of staff who they know should be appearing in court to go on holiday is a diabolical waste of court resources. The Mags all nod their heads in unison as the CPS prosecutor hangs hers in shame. Chairlady of Mags says they agree and it is their wish that the trial proceeds today. CPS prosecutor stands up and states "if that is the case then The Crown offers no evidence". Mags say "CASE DISMISSED". Bloody Marvellous. In jubilation I run out of court and forget to ask for costs. Not for long though as my wife who was waiting outside immediately said "Did you ask for costs?" I humbly return to court and explain that I forgot to ask for costs and would Their Worships please allow my claim. They say "Certainly" After a bit of haggling I receive £171 from Central Funds. Don't roll over and yield. Stick with it. In the end they made it so very easy p.s. Conspiracy Theory Time What's the betting the CTO Clerk knew he had sent the letter 2nd class and didn't want to contradict his statement or perjure himself. Maybe that's why he didn't want to appear. Who knows? -------------------- -----------------------------------------

I've had a search, but in the one that I found, the NIP had been served after the 14 days. |

Another plus for those that do not like it up em.
Well done! As Jeffery has said, would like to see the case. Sick, on holiday, compassionate leave and even car has broken down on the way to court. All familiar excuses. |
