Hello everyone, first time poster here. I hope someone can please help.

I have been issued with a PCN last week for being in a bus lane at night on Sheepcote Street Birmingham. I've just read online this bus lane fine came into effect on 2nd September 2019 (so very new) and that thousands are being made from this new camera.

. I had no idea it was a contravention but also I had no option but to turn into that road (left I believe) because of awful roadworks and closures and confusing signs around the area. It was very dark and so visibility was hard also. I believe I turned into the road as it was my only safe option to do so.

I had a letter come through from the council a few days earlier as I had taken the same route but in the first letter the council sent a warning ' NO PAYMENT' required notice. I did not know that I had made the error both times/ The second letter is asking for 50% of £30 if paid within 14 days - I simply do not have this money as am a lone parent and have very little income. The full charge is £60.

The PCN says the contravention was a CODE 34 being in a bus lane (as defined in S.144(5) Transport Act 2000 (as amended).

I have read the forum rules and attach a photo here -with all details scrubbed out, but please let me know if you need some of the details in the photo put back in. I have the link for the video but if I post here my reg will be seen (and identifying me). I also believe I was in the lane for a very short time. I did not intentionally break the law and am really stressed by this notice.

Can I appeal this please? I only have a few days to write the appeal.

Obviously if the adjudicator tells the council to provide further evidence, the council can provide further evidence. You need to post the press clipping but in the meantime send this message:

Nowhere does the statement assert that the camera device in question is a Zenco Systems Lanewatch camera, the fact that a reviewing system called ZenGrab was used does not show that a Lanewatch camera was used to capture those images, the images could have been captured by a different camera system, for example another type of camera manufactured by the same manufacturer.

The council has still not asserted whether the camera in question is a LaneWatch camera, it seems the council is inviting the tribunal to infer that this is the case but it is submitted that the council should have provided evidence rather than referring on an inference, given such evidence would be easily available to the enforcement authority

The adjudicator wrote the following message for the council/ added this message to the file on 22/01/19. However is this allowed for them to allow more evidence from the council even after the date they gave to the council to submit evidence by please? :


" To the Council;

The representative has made a detailed submission on 14/01 including further evidence.

The Council is directed, should it wish to address the technical issues advanced to provide a written response. "


I have written the above message and added to the file - thank you. How long will it take for the tribunal to make a decision please?

Were the redactions to the TFL letter applied by you or by the council? If it was you, please re-post an unredacted version.

Well firstly these documents are a matter of public record, and employees of public authorities have no reasonable expectation of privacy in these circumstances. More importantly, having the unredacted version makes it a lot simpler to make an FOI request for all the underlying documents.
