Hi all,
First time receiving a NTK letter for a parking charge notice and I'm after a bit of advice on how to respond to the letter and whether or not I should contact the garage concerned or if I write directly to the issuer of the letter (Euro car parks). Basically, the letter states that the vehicle entered the premises concerned at 16:00 and departed at 16:56 and this time exceeds the maximum allowed as shown on the signage. I don't dispute that the times shown are correct but the vehicle wasn't parked as such. The car was actually queueing up waiting to use their car washing facilities and then actually being washed by the driver It was the first sunny day we had for a while and there was a long queue of vehicles waiting to use the wash and all of this would easily be verified from the CCTV installed at the garage. I know that I can appeal either in writing or online but before doing so, I was just after a bit of advice as how best to work the appeal to show that the vehicle wasn't actually parked up but was queueing waiting to use the facilities of the garage in question. Have a go at the operators of the garage. Do you have receipts?
This situation seems to be getting quite common. No amount of appealing will get them to cancel, they want the money What do the signs say? Can you post up a redacted copy of the NTK, but leave dates This post has been edited by ostell: Mon, 12 Apr 2021 - 10:48 |

Also, edit your post and do not give any indication as to who may have drove the vehicle.
Refer to "the driver" queued etc. You received this as the keeper and appeal as the keeper. |

No receipts I'm afraid as it was a coin operated jetwash.
I do have a dashcam in the vehicle and as sod's law would have it, some of the footage has not been recorded over as the incident was almost 2 weeks ago but the footage remaining does show the vehicle still in the queue at 16:33, getting washed then leaving the garage at 16:56 so this covers 23 minutes of the time in question. For an appeal:
Dear Sirs, I have just received your Notice to Keeper No. xxxxx for vehicle VRM xxxx You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give the invitation to keeper as prescribed by section 9 (2) (e) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper. There is no legal requirement to name the driver at the time and I will not be doing so. I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records. Yours etc First class post with free certificate of posting from a post office |

If you appeal online be careful as not to tick any box that says "driver"

Well, I popped into the garage and had a word with the manager and he said that he would send off an email to the parking company requesting that they cancel the penalty charge.
I'll wait and see if I hear anything further from them. |

That was certainly quick.
I just went to the ECP appeals webpage to enter my appeal and the penalty has already been cancelled so I'm assuming it's because of the petrol station manager contacting them. Many thanks for the help and advice given. This post has been edited by Mrgreenie: Tue, 13 Apr 2021 - 09:35 |
