personal disabled bays

A disabled bay has appeared in a village close in which a relative lives. The bay and DISABLED is marked on the road but there is no sign plate.

On checking it appears the local council provides such bays on request subject to the applicant having a Blue Badge and no off-street parking.

However, reading the websites of a number of other local authorities it appears these bays are advisory only, can be used by anyone with, or without, a Blue Badge and are not enforced by CEOs.

Ignoring any ethical point any comments on the legality of these bays please.

A challenge against the lawfulness of such charges is not something the LGO could easily ignore and could draw them indirectly into the legality of advisory bays.

I suspect as I would not be eligible to apply then the LGO would still say I had no personal interest in the matter and so they would refuse to adjudicate on it.

You'd have to find an eligible individual, get them on board and then you could pursue a complaint as their representative.

I can't see one getting involved as then they would be fighting not to have one!

So file a complaint on behalf of one of their neighbours to try and get the bay removed, then when it's removed file a complaint on behalf of the disabled person on the grounds that they never should have been charged in the first place.

Worth a try, we have one in our street I'm sure isn't back by a TRO, I don't use it as the person concerned does have mobility issues.
