Cornhill Again - Contravention Code 52M - No offence, PCN clearly incorrectly issued

Posting this not so much for assistance (although I wonder if City of London should be taken to task over it) but more for your amusement / indignation (delete as necessary).

Do City of London even check their PCN's before they send them out? We just received another PCN for this location for a driver that knows the prohibition well and knows the route around it. Ignoring the fact I've not posted the PCN as I pretty much know what I'm going to be telling them, watch the video and see what you think.

Here's a link to GSV of the junction where the alleged offence occurs. Our vehicle is captured in the video roughly where the van is parked on the left.

lol the van barely moved. But despite the amusement we wasting our time writing email to them for something over nothing. I'm still waiting for them to get back to me for the same incident as whats shown on this clip

I wonder do they manually mark up the video with the "Contravention" pop up or is that automated? Either way it's certainly flashing up nowhere near the actual point of the alleged contravention and to be triggered by a van reversing slightly to tidy up a parking manoeuvre when obviously traveling in the direction which is permitted is crazy.

Some knowledge on the subject of false and malicious claims might be useful. Surely authorities should be accountable for issuing PCN's when there's clearly no offence being committed!

Laughable!

It's well beyond time for CoL to stop issuing PCNs in the Bank area anyway and get their act together with the Experimental TMO.

Like the Manchester Oxford Road shambles I would suggest appellants seek costs orders where this type of thing happens or where there is a slew of ETA cases pointing to line and sign non compliance.

Update.

Finally had confirmation that the PCN has been cancelled although they insist the vehicle passed through a prohibition sign and was seen to be doing so which is total fiction.
I guess they are dealing with so many of these they just quickly cut and paste with little care or attention to what they are doing.

Wow you get a reply but I don't. And that letter you recently got is daft as you are currently able to go through the bank junction if your coming from Queen Victoria Street. This is due to the closures of the roads around the city

Took just over 3 weeks for them to come up with that (poor) response.

My very simple informal reps for info:

Dear Sirs

Re: PCN Number CL54*****

I refer to the above numbered PCN.

Can I respectfully request that you revisit your evidence and cancel this PCN as the stated alleged offence clearly did not occur?

Notwithstanding the fact that numerous successful appeals to adjudication confirm that both your signage is incorrect and that you fail to actually prove the offence with your photographic ‘evidence’ this PCN was so clearly incorrectly issued that I find no need to actually detail the reasons for your cancelling it.

I look forward to your written confirmation confirming cancellation and would expect an apology for its issue in the first place together with an assurance that your operators will be retrained to ensure the avoidance of such similar mistakes.

biggrin.gif laugh.gif It does leave me with the impression that you could just write anything in the appeal and they would cancel it regardless. They also recently cancelled mine as well
