NIP Details and Circumstances
What is the name of the Constabulary? - Date of the offence: - April 2019 Date of the NIP: - 80 days after the offence Date you received the NIP: - 82 days after the offence Location of offence (exact location as it appears on the NIP: important): - M23, J10a, Balcombe Road overbridge, Crawley Was the NIP addressed to you? - Yes Was the NIP sent by first class post, second class or recorded delivery? - Not known If your are not the Registered Keeper, what is your relationship to the vehicle? - It is my wife's company car that is leased by her company How many current points do you have? - 0 Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - I was speeding because I was late. OK, it's not a defence. But I'm curious as to why I haven't been offered a speed awareness course. I did go on one before but that was more than ten years ago. NIP Wizard Responses These were the responses used by the Wizard to arrive at its recommendation: Have you received a NIP? - Yes Are you the Registered Keeper of the vehicle concerned (is your name and address on the V5/V5C)? - No Is the NIP addressed to you personally? - Yes Although you are not the Registered Keeper, were you the keeper of the vehicle concerned (the person normally responsible for it) at the time of the alleged offence? - No As you were not responsible for the vehicle, somebody else has named you as the driver. Were you driving? - Yes Which country did the alleged offence take place in? - England NIP Wizard Recommendation Based on these responses the Wizard suggested that this course of action should be considered:

What was the speed limit at the time?
The reason may be that 4 months have already elapsed since the alleged offence, which is normally the point where courses stop being offered. |

Probably because of the time since the offence, a prosecution for a speeding offence has to be commenced within 6 months, so some time in October in your case. That could well be less than 2 months which is the minimum time often used by the police. The nomination has presumably gone through a chain of a lease company, your wife's company and your wife before you were named. As everybody has 28 days to respond the delay can build up, it is not your fault but that is the way things have turned out.

Thank you both for your replies.
The speed limit was 70 mph. Yes, four months would have elapsed about a week and a half after they sent me the NIP. Ah well, I guess I'll be more careful from now on. |
