Received a parking charge notice from NHS

Good evening all,

Firstly, my sincere apologise if my post is in correct or in the wrong section. I’ve spent the past hour going through the FAQ’s and I’ll be honest, I’m perplexed and confused. mellow.gif

A driver to visit my sick father at the hospital today and after attempting to purchase a ticket, the machine declined 4 cards and that of other visitors attempting to purchase a parking ticket. The driver doesn't carry cash if any sort, with regrets today and nor was the driver Near anywhere to withdraw cash.

The driver went to the receptionist in the relative wing who advised to leave a note and that will be sufficient. The driver was sceptical but, did as requested assuming the receptionist would inform their parking department.

Upon leaving a short while later, the driver return to find a parking charge notice on my car and around half a dozen if not more, others.

The rate was £2.80 for 2 hours and it’s the ticket the driver buys near enough every few days as the driver attends 3 times a week.

The driver is going to appeal in writing and explain the machine was faulty due to declining cards but, could anyone of you with a bit more experience advised on what to say and how to word it?

The car is not registered to the drivers name but as its their fathers car who is in hospital after having a major stroke.

The ticket is from the Leeds teaching hospital trust and it’s states ‘PARKING CHARGE NOTICE”
It’s has a PCN number and worded as such: “parking officer Xxxx who had reasonable cause to believe that the following parking contravent has occurred: Failure to display a valid pay and display ticket.

Your Dad would win at POPLA anyway, as he wasn't driving, which is why the appeal/complaint MUST come in his name, never the driver who hasn't got that 100% winning position for POPLA stage.

Dear Sir/ madam,

I am horrified to learn about a distressing matter as my vehicle was left with a ticket attached on 15:42 date: 13/10/18 with a parking charge notice PCN: XXXXXX. The vehicle was parked at the hospital from 14:27 and attempts were made to purchase a ticket. After trying 4 different cards using the only machine in the car park, all attempts displayed 'declined'. After waiting a few minutes and letting several other people whom were waiting in line make an attempt, their attempts also failed. This proved the issue was with the machine.

Unable to make any payment, at 14:33, the number on the board 0113 39 25057 was called and this went to an answer phone inbox which was full, not allowing any messages to be left. The reception desk at the Jubilee wing was immediately informed and the issue explained regarding with paying for parking and a request was made if there was anyway to pay at the desk. They advised that there was 'no other way but to use the machine and if it was not working, leave a note and it will be fine'. Taking this advice from the NHS reception desk at the Jubilee wing, a note was displayed stating the issue with payment with Ward number and time of arrival.

Upon return to the vehicle at 16:22, a yellow ticket stuck to the windscreen. I was not the driver (who will not be named, to protect my family from an escalation of this shocking intimidation) but you are pursuing and trying to penalise me (your patient) because I am the keeper of the vehicle.

Moreover, a member of the family tried complaining to PALS via phone and was rudely and immediately dismissed by a very abrupt person. They advised to contact according to the ticket as it is a Patients Advice Liaison service and not a 'parking advice' service. Near enough in those words - to say we were shocked is an understatement.

I AM your patient and I AM currently being hounded for an unfair charge arising from the driver purely following the advice given by the hard-pressed staff on Jubilee Wing. Of course this harassment by the Hospital is a matter for PALS to listen to, investigate and handle properly. If the problem is that PALS are getting too many similar complaints, surely rather than fob poor upset people off, you need a better way of handling such complaints, properly.

Did those responsible for this terrible method of fining people at Hospital stop for one minute, to consider how far wide of the mark your current parking enforcement regime falls outside the Government NHS Parking rules?

Since PALS are washing their hands of this ubiquitous problem, how does one achieve the promised by Government ''waiving of the fine''? POPLA only consider the contract law issue, not mitigating circumstances, in order to waive an unfair charge, so you cannot offload the issue to POPLA. It seems to our family you are currently failing to meet the above criteria.

This is the very last thing I and my family should be dealing with and I trust you can now step in and cancel it to put an end to this ordeal.

You/the Trust must consider this my 'appeal' if you really want to put me through the rigmarole of POPLA to get it cancelled. As I was not the driver, you may or may not realise, I have been reliably informed that you cannot win at POPLA against a registered keeper appellant, so this is a complete waste of everyone's time as well as an abject disgrace to harass a very ill patient this way.
I have received help to construct this complaint and am sure you appreciate I have better things to be worrying about right now as I have had a severe stroke and unable to move much as I lay in ward L12 E floor in the jubilee wing. I have attached a copy of a letter from my ward doctor.
I cannot believe the NHS Trust allows such harassment of registered keeper patients, and worse, that it was due to the advice from the NHS staff reception regarding leaving a note.
I think the system needs a change and better management is required. The contact number to call listed does not actually go through to anyone but, to a voicemail that does not accept messages, this has been tried numerous times since, to make sure.
Patients like myself have family who make an effort at their time and expense in order to ease the burden on all the hard working NHS staff, whom for which I have the utmost respect for, as they have been more than a blessing in caring for me after this severe stroke.

Have quotes from the NHS Car Parking Principles handy; it's not something I'd expect a Head Nurse to have to know about so it will be up to YOU to point out the Government policy.

And when posting an appeal, use ordinary 1st class post, address it to a specific person or Department (appeals?) and go to the local PO and ask for a FREE certificate of posting.

Great advice. I will print off the parking principles and show her. She always seems grateful when i attend as tasks like showering patients and feeding takes up a lot of their time and i am happy to get hands on and help my father.
