Hello,
We have received a charge notice for 'exceeding free parking period at Service Station' for a vehicle registered to the company. They ask for the drivers name. The images are not clear. It is impossible to verify vehicle or who the driver was. Made an appeal but they sent another 'standard' letter which did not seem relate to the points made in the appeal at all. Timings (dates) stated also seem to be inaccurate, e.g. they say letter was issued on 11th of October, but we actually received it on the 15th (thus cutting short the time we have to appeal). What should I do; they offer POPLA appeal. Cheers, GM Our appeal To: Appeals Section PO BOX 3573 Barnet EN5 9QA From: Limited Company Appeal against charge notice – Ref XXXXXXXX Dear CP-Plus appeals team, We have received a charge notice from you withRef XXXXXXXX regarding one of our vehicles being parked in excess of the free period at ‘Roadchef’, Annandale Water. Your charge notice asks us to identify the driver and you have attached images to your notice as proof. We are happy to assist you in this matter and settle any outstanding parking charges if indeed our vehicle was parked on your client’s site - ‘Roadchef’ - Annandale Water. However, from the images provided by you it not possible for us to: 1. Identify the driver 2. Confirm the type and make of the vehicle 3. Confirm if the vehicle was actually parked in a parking bay or not Hence, we appeal against the above penalty Ref XXXXXXXX sent you us on the 15/09/2016. Further, we ask you to provide additional evidence that our vehicle was indeed parked in one of the parking bays ant not merely passing through. We are looking forward to your response. WHAT DO WE MAKE OF THIS???? LETTER FROM POPLA ASSESSOR: The operator has contacted us in response to your appeal. They have advised that they issued the POPLA verification code for a Scottish site. POPLA can only assess appeals for Parking Charge Notices (PCNs) issued in England and Wales. It is not within POPLAs remit to assess appeals for PCNs issued in Scotland. OK , no POPLa appeal , what now? , all PPCs must provide an indipendent appeal service?

Report them to the BPA for failure to provide an independent appeals service
Ask dactyl what sanctions they will apply Isn't this also a breach of kadoe? |

My only worry is in the wording of the appeal in post #1.
If they provide evidence of any of those three points, you could be stymied in court. Be very, very careful about the wording of any correspondence. Get it checked here first. -------------------- Cabbyman 11 PPCs 0

Just to update everyone. We've received a reply to our last letter. "Thank you for your correspondence concerning the above stated Parking Charge Notice. In light of your claims, the representations stated in your appeal have been note and upheld. We can confirm this Notice has been cancelled in full and no further action will take place on this occasion. Yours sincerely CP Plus Limted" Team victory!!! |

Hi. I have today received a charge notice from CP Plus. I was parked in a car park that offers free 2hrs parking, but my appointment overran meaning I overstayed by 31mins - am I in a position to appeal this charge notice? It’s dated 7th August & I have been away from 5th - 20th August, hence why only posting now. Please see attached documents. Any help would be much appreciated. Thank you
