Hi,
Hoping for some help: I parked on a single yellow line in Charlotte Road, Hackney at about 20:00 on a Saturday night, looked about for signs but none to suggest i couldn't park there - I didn't know anything about CPZ's until i started looking into this having been towed and stuck with a £260 bill. I'm hoping to get up there tonight to take photos - is there anything i should be looking out for? I think from what i've read it looks disappointingly like my PCN is as it should be. So my question is, do i have any grounds to appeal against this? To be honest, all the cars parked around me in the Resident's only bays just got fines yet I got towed despite not obstructing anything - seems a bit unfair to me? Any advice much appreciated. |

And where are the rest of the documents?

I got a five page print out entitled 'Representations Against Removal of Vehicle' and there was an empty PCN envelope still on the car, that's it - do you need those?

Not the PCN envelope but the rest of it might be important, don't you think?

There it is - annoying thing is, if i hadn't asked for an appeal form i don't think they'd have given me it which might have made life easier.

ARRGHHH !! but whats done is done.
Note for other readers - never ask for the appeal forms, take what they give you, keep quiet, pay up and bugger off. then post up what you got up here. -------------------- Which facts in any situation or problem are “essential” and what makes them “essential”? If the “essential” facts are said to depend on the principles involved, then the whole business, all too obviously, goes right around in a circle. In the light of one principle or set of principles, one bunch of facts will be the “essential” ones; in the light of another principle or set of principles, a different bunch of facts will be “essential.” In order to settle on the right facts you first have to pick your principles, although the whole point of finding the facts was to indicate which principles apply.

they are required to give you one - failure to do so will gain a fuill refund
you should not have to ask you should not be asked if you want one - it shoudl be given automatically i think hackney docs are compliant now |

have i got anything to appeal against the tow? I rarely drive into london and wasn't aware of CPZ's or that they don't have to put signs next to the yellow lines - ok, fair enough, my mistake maybe, £120 reduced to £60 i could live with but getting towed seems really unfair as I wasn't blocking anything and everyone around me in residents only bays only got PCNs - I actually thought taking the single yellow was the sensible choice!

Yes, hackney yellow line CPZ tows are a total scam IMO.
Assuming the docs are correct (which they seem to be), i suggest you check that there are CPZ signs visible at all possible entrances to the CPZ. -------------------- Dave-o 3-0 LB Waltham Forest.

I'm going now to check the signs! Feel like I've been robbed of £260 for actively trying to park legally.

Perhaps you could Michael Sobell of Graham White Solicitors for his opinion? Eh? Isn't he one of those bogus PPC "solicitors"? -------------------- Dave-o 3-0 LB Waltham Forest.

Haven't managed to get photo's of the CPZ signage - Is there anything in the fact that the From/At and To times are only 5 mins apart - are they supposed to wait a certain amount of time before removing your vehicle?

Ok, so if I assume at this time that their signage is correct, I'm going to appeal anyway, just because I think it's a total abuse of the system. Have you got any advice as to what I could or should mention?
And if I get as far as PATAS(?) - what are the risks to me - costs?? |

There is no harm appealing, as you have nothing to lose.
Have you checked for CPZ signes at all entrances yet? This IMO is your best route. Get some pictures of the CPZ signs too. -------------------- Dave-o 3-0 LB Waltham Forest.

I haven't checked the signs yet. I will though and post the photos if there is anything untoward.

It is the entry points to the zone you need to check.
Zone B North. It isn't big. Map on website. - -------------------- |

Pictures of the CPZ sign. It's really well placed so as you're coming from the down the main street and turn right into it, it's obscured by the building and one way sign. There's a sticker over some of the time too.
This is another way in - one sign again and a sticker over the day. Included a picture of the single yellow line where I was parked in case there's anything wrong with that and to show that I wasn't blocking anything. This post has been edited by balind0: Thu, 19 Mar 2009 - 21:02 |
