UKCPS Parking Charge, Parking in Disabled bay

This letter was received today.
This was whilst the driver was outside nandos collecting an order. As no other parking spaces were available the driver opted to use a disabled bay as they were the only available spaces.

I have spent the last few hours reading various posts and this has got me more confused. I guess I'm just asking for advice as to whether or not this should be ignored, disputed/defended, or paid (guessing that no one will say pay?).

I have also attached a photograph of the sign. not the greatest photo - The driver took it as they were told that a man was taking photos of the car and expected to receive this letter in the post.

Would I be correct in thinking this is NOT a PCN as nowhere does it say penalty charge notice or even the word penalty. It just states its a parking charge.

Also this is a FREE car park

Yes, it’s a civil parking charge notice, its not for anything enshrined in statute.

That doesn’t, of itself, make it unenforceable, but the only way they can make you pay is to take you to court (and win).

Just be aware not to ignore it, ukcps seem to take a stance of issuing court claims

They also like the sort of 'morally wrong' type of claim like yours, where they feel a judge would side with them for you using a disabled bay when you shouldn't.

They don't seem as litigious as they used to be but a court claim is quite possible. They will reject any possible appeal you make.

So either pay it at a discount or wait and see if they issue a court claim - they have 6 years to pursue.

However the KEEPER should still appeal, as you have then engaged

You could argue that the driver was loading and therefroe not parked

However as pointe dout above, parking in disabled spaces is not going to go down well in court, and is not the only choice.
