The question is are vehicles being stopped purely to satisfy bailiffs?

A complaint is pending with the MPS and the whole policy is now under review.

I expect MPS will soon stop assisting bailiff scum.

In the meantime, tell anyone who is stopped by police:

If you’re stopped, the police can ask to see your:

driving licence
insurance certificate
MOT certificate

If you don’t have these documents with you, you have 7 days to take them to a police station. You’re breaking the law if you don’t show the requested documents within 7 days.

Show, does not mean give, you can show your docs from inside the vehicle with the door shut (locked). You should wind the window down an inch so plod does not have
to shout. You are entitled to ask why you were stopped.

When plod is finished you ask 'am I being detained?' plod says no so you drive off. If the bailiff is in your way hoot the horn and ask the plod to move him to prevent a breach of the peace.

The courts have ready stated that the power to demand documents include the physical inspection of them so you'd be committing an offence if you just press them against the window and leave it at that!

you are entitled to drive to the nearest police station and do it there.

QUOTE (fsa3011 @ Mon, 5 May 2014 - 15:52) *
So far, I have written this. Anything to add/edit?

I hereby make a representation regarding the aforementioned matter based on the following grounds:
1. Incorrect contravention code on PCN: the appropriate suffix after the alleged contravention code to indicate camera enforcement has not been used. The correct code would have been 53J. A PCN is unenforceable with the incorrect contravention code. Furthermore, there is no direction of travel indicated on the PCN.
2. Lack of evidence on PCN: Whereas the sign allegedly contravened is a "motor vehicles prohibited" sign (appearing as such in both the 2002 Regulation/Directions and the Highway Code), I note that not only does the Penalty Charge Notice ('PCN') refer to "Failing to comply with a sign indicating a prohibition on certain types of vehicle" (rather than "motor vehicles", which are statutorily defined in the London Local Authorities and Transport for London Act 2003) but it also fails to include a picture of the sign allegedly contravened.
3. Lack of restriction pre-warning: there is only one sign before the junction with Station Road which states: ‘Entry to Station Road restricted 75 yards’. This pre-warning sign does not convey sufficient information as to the nature of the restriction in place on Station Road. It gives no indication that Station Road is pedestrianized and limited to ‘local buses, taxis and for loading’.
4. Restriction signs on entrance to Station Road: one has to physically enter Station road past the junction to see the restriction signs.
5. No U-Turn sign: this is present just after the restriction sign on Station Road. If one inadvertently enters Station Road, they are prohibited from turning around and leaving. This series of poor signage amounts to extortion.
6. Camera evidence: the Council has failed to provide evidence that the cameras in use to enforce this alleged contravention are endorsed for their use in this instance and are not Bus Lane enforcement cameras.

sorry but this is mostly a load of rubbish.

Keep it simple:

1. The PCN photo does not a sign being contravened or a sign in isolation.

2. Lack of adequate advance warning sign(s).

3. Location of contravention not adequately described.

where is the authority for the plate?

I think you are all missing the point on the small yellow line, if the event plate was not there then it would probalby be okay.

I will ask Judith T

QUOTE (EDW @ Mon, 5 May 2014 - 10:16) *
I dont agree, this relates to kerb blips.

Look at the cross line on the SYL, ignore the kerb blips.
If you check TSRGD, terminations lines can be made into one and this is usual when joining SYLs to DYLs and in that case would be clear as the two types of lines are clearly different, hence different restrictions.

But to merge the two terminations on SYLs cannot be clear unless, as with the picture OP posted or with the diagrams Qafqa posted, there are pole signs that make it clear there are two seperate restrictions or some other way of making it clear. Breaking the SYLs and putting two termination bars would IMO be clearer but still not clear enough unless the break was significant.

In this case, council have painted a single termination bar but IMO we do not even raise the issue. Let the adjudicator find it if they are minded to look.
With the way pole signs are placed in relation to where the vehicle was, there cannot be any clarity to which pole sign applies.
Even if adjudicator looks for and finds the bar, the question of clarity is paramount and IMO cannot be found in council's favour.

As far as it goes, even with a termination bar, to all intents and purposes, certainly at first inspection, it is a single yellow line and OP is entitled to rely on whichever restriction they see that seems to relate to the yellow line.
It is councils duty to make it clear that there are two seperate restrictions.
They fail in that duty.

I doubt you are correct but I will check.

can you please provide more details - does not say no right turn on Road or Sign or PCN ?

Probably because the PCN says " performing a prohibited turn" without saying exactly what ..hopefully EDW will explain .

There is certainly a No Right Turn sign on the pole and also wording on the road but the latter might be regarded as "advisory"
