I did SORN it but do not recall receiving an acknowledgement. Thats not to say I didn't get one, just that I guess it's not someting I would pay much attention to if received (I now obviously know better!). By the time I was looking it was probably June time, and so I was trying to think back to Jan/Feb.

I'm not really sure whether the dvla were trying to say it wasn't listed as SORN by asking me for the acknowledgement, or if they were just trying to get rid of me by hoping I hadn't kept a copy, as I had asked them twice at that point to explain what the exact offence was & they were sending back really vague template crap.

I tried to ask the clampers office what the problem was at the time, but the girl at the end of the phone just said all clamp operators are trained to only act where dvla approved etc. She did say I could ring the dvla local office and clarify, but it was a bank holiday, so by the time they were open again the release fee would have doubled :-( - plus it was a bit of an pride/ embarrassment thing with the neighbours to be honest...

Anyway, all the copies of letters are attached to the summons as evidence, along with a ticket print out which must have been produced by the guy when he put the clamp on.

Which is why I wondered whether this was an 'on road' offence, as the correspondence attached seem to contradict this?

Thanks Jimster, so busy trying to find the legislation, I didn't think to check the basics mellow.gif

As no one has jumped & up and down saying the dvla / courts are wrong <as I respect your opinions!> I will assume I was technically on a public road & plead guilty.

Anyone know what the going rate fine for these offences are?

I am not really wanting to pay the tax for the time it was untaxed as it wasn't in use... do you think if I attached a photo of the location as mitigating circumstances, that I genuinely did believe it was off road, they would go easy on the fine & waiver the back tax?

Is that on road?

One of the problems I am having is trying to find an 'on road' dvla definition?

I've read different things about driveways/car parks etc

The bay is not painted off to specific house numbers, so cannot be classed as driveways.

There is a pavement running between the bay and the road though.

Hi,
I'm hopeful someone here might be able to clarify whether I've been summonsed under the correct offence code (or whatever it's called) and how I can change it?

Back in April I got a dvla clamp on my vehicle which was parked off road in a residents parking bay on my housing estate.
I had sorn the car at the end of January via post.

I paid to get the clamp off as there seemed no other option at the time other than to get the car towed (& get charged for the pleasure).

Few weeks later I got a vague letter from dvla saying I had committed an offence & could accept an out of court settlement.
After a few letters back and forth (me asking 'what specific offence', them saying 'changes from October 2008'?, then saying they will not enter into further correspondence without an acknowledgement letter from the SORN) I couldn't find any paperwork so lost the will to live and half forgot about it.

Then this week I received the summons saying the offence is '...kept a motor vehicle for which a licence was not in force, contrary to Section 29 (1) ....Act 1994...'

I have tried to have a look through these forums, and via google - is this offence not specific to the vehicle being 'on road'?

Any help or advice appreciated, thanks
