Off topic quick consumer law question please.

My daughter arranges hotel accommodation for the four of us using her account on a well known online hotel booking site. I pay using my debit card. When we arrive the hotel have double booked. They apologise, promise a refund and we stay elsewhere. Two weeks later the promise of a refund has vanished and they will not refund. I need to use the small claims court. All very straight forward.
However if its my debit card that paid but my daughter is the one making the booking using her account, who makes the claim?
The contract is with her but I am the one who lost the money.

Well in theory you can have multiple claimants but as you're the one who's suffered a loss, I think it would be more practical for you to claim. Things might have improved since but last time I needed to use moneyclaimonline the facility didn't allow for multiple claimants.

Have you tried the hotel head office (assuming it's a chain) before you go racing off to MCOL? I've had success in the past writing direct to the CEO/MD.

its not a chain - the person at the top is the same person who changed their mind about a refund once we had left.....

Get onto your card provider and start a chargeback claim. The facts appear clear. You paid for something you did not recieve due to the vendors mistake.
Hopefully your debit card is Visa who are much easier to deal with in charge back cases.
