Hi all. I received this pcn. I wasnt the driver at the time etc. I just wanted to make sure before I appealed it that these grounds still apply?
--------------------------------------- Sirs Ref PCN xxxxx VRM yyyyyy I am the hirer/keeper of the above vehicle and am in receipt of the PCN you issued. I have no liability on this matter as you have failed to meet the requirements of Schedule 4 of The Protection of Freedoms Act 2012 namely, but not limited to, failing to supply the additional documents mandated by section 14 (2) (a) of the Act. You cannot therefore transfer liability from the driver at the time to me, the hirer keeper.. There is no legal requirement to identify the driver at the time and I will not be doing so. Any further communication with me on this matter, apart from confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. ...copy to PE first and get them to confirm cancellation, and send this email to Sofia. Nicely worded and factual.. Dear Sofia, Thank you very much for your efforts, much appreciated etc..etc... To avoid crossed wires I have today sent this email to Parking Eye: Dear Sir, PCN ************* Please see attached correspondence from the Radisson Blu Hotel confirming that they will cancel the PCN. As we have a scheduled POPLA assessment arranged, I should be grateful if you would please confirm that you have now withdrawn your claim. I will of course do similar as regards my side once I receive this confirmation. Regards.... Keep everybody in touch. |

Although the email from Sofia confirms no such thing. It simply offers to 'correspond with the motorists and/or cancel the charges where applicable'. It also specifically mentions a case that is with the independent appeals service (POPLA in this case) as an example of a case where they cannot cancel.
That said, Hcandersen's suggested email is still worth a go, but be sure hot to miss any POPLA deadlines. -------------------- Useful Links (for private parking charges):

Agreed. I suspect 'with independent assessment..' is there to ensure that they don't tread on jurisdictional feet. But as no-one has heard this issue yet I would suggest we're talking about a prospective appeal not one which is 'with'. We shall see. IMO, you don't have a defence, the numerous posts on this subject were simply trying to find the best argument to put when POPLA was inevitable and there was no financial downside in taking it further. But now there is and it's £80. |

It's your call to make... If it were my money on the line, I'd probably consider £20 a reasonable cost to avoid the faff of court, but it's entirely your call.
