Hi
First time Caller. I was wonder if someone can help Reading the thread http://forums.pepipoo.com/lofiversion/index.php/t131382.html the same issue has happened to me. Wellington Street heading East off sprawling roundabout. I wonder if I could also be successful and what are the steps I need to take? A link to the video is https://youtu.be/BN3FqR6oDdw Location https://www.google.com/maps/@51.5079853,-0....6384!8i8192 Hopefully cp8759 and HiHoSilver might be still Cheers Bob |

The links to the video and GSV don't work, at least not for me. Sight of the video is essential for advice, as your next stage is adjudication or cough-up, and they have re-offered the discount, which is not available at adjudication, it's the full penalty of £60 in play.

As regards the contravention you are bang to rights
But the error on the PCN re reg 8 has not been corrected and there is a further error we date on the notice of rejection. IMO you have a fair chance at adjudication -------------------- All advice is given freely. It is given without guarantee and responsibility for its use rests with the user

Hi
Try this link to video https://www.youtube.com/watch?v=BN3FqR6oDdw...eature=youtu.be Actually watching that the video the learner driver is cutting across me. If you look at the other thread regarding the placement of the bus lane sign warning it is in the wrong place. It is sign on top of where the bus lane starts and you have little warning. What do you mean by "But the error on the PCN re reg 8 has not been corrected and there is a further error we date on the notice of rejection" So are the forms incorrect and thus invalid? Thanks Bob |

The PCN is required to tell you this
QUOTE (n) that the recipient may, by notice in writing to the authority, request them— (i) to make available at an office of theirs specified by him, free of charge and at a time during normal office hours so specified, for viewing by him and by his representative (if any), the record of the contravention produced by the approved device pursuant to which the penalty charge was imposed; or (ii) to provide him, free of charge, with such still images from that record as, in the authority’s opinion, establish the contravention. (6) Where the recipient of the notice makes a request under paragraph (5)(n), the authority shall comply with the request within a reasonable time. I could not find it anywhere, can you? or even anything like it. It doesn't have to be word for word. If its not there then the PCN is an invalid document -------------------- All advice is given freely. It is given without guarantee and responsibility for its use rests with the user

Hi
So do I go back to the council and tell them that or do I say it at the adjudication? Thanks Bob |

Hi So do I go back to the council and tell them that or do I say it at the adjudication? Thanks Bob you have had you shot at the council so it off to adjudication. We need to see your representation so we can gauge the response from the council and perhaps tweak it a bit for the tribunal -------------------- All advice is given freely. Hi
Can you see the document images I attached? It is in the top row pages. Let me know if you can't see them and I'll paste the detail in. I wrote down what I recollected. Interesting when I got denied they then posted a link to the video which shows a learner driver cutting across me Thanks Bob |

Hi
The response I sent back was Dear Sir or Madam ''' I wish to appeal the Bus lane penalty charge PCN SB40667319. I am not a familiar with the local area and was only visiting Slough to go to the Smyths Toys to buy my daughter a birthday present. On our way back I was driving along the A4 trying to get onto the M4 ,but saw a Sainsbury’s in the distance. Due to the current madness of people bulk buying toilet roll I decided to make a impromptu stop to see if the store had any. On the approach it is not immediate clear how enter Sainsburys. I first turned left which took me in the wrong direction over a bridge. I then turned back and tried another entrance which seemed to be for deliveries but that was not obvious. Third time lucky I then took a left off of the roundabout but immediately it was not clear where the bus lane starts and the entrance to Sainsburys begins? From the pictures you can see that the traffic is low and I am not gaining any advantage. It just is confusing on the approach which way to go to enter Sainsburys if you are not familiar with the area. ''' Bob |

I told you you have until the 2nd of June, Your appeal is purely technical so what did you send to the tribunal when you registered the appeal -------------------- All advice is given freely. PMB just as an observation the compliance of the camera system with the 2005 order is an issue that can be added. We should have the decision from the Reading case before this one needs to be submitted, I'll let you have a copy then I get it.
