They seem to prefer the underlying offence, not MS90. Its too much of a catch all.

If you have already sent a lcease and desist citing harassment, send them a LBA showing the issues since - itemise the calls, and the fact they even used a new number in the hope you would answetr this one - and inform them you WILL sue them if they continue.

INdeed, you can point out that the4re is no condition requiring the badge is displayed, and as such the charge cannot have been issued correctly. Expect POPLA to fail to agree.
Nothing abbout what those concession are - free? reduced? An ice cream? So you can make a CRA2015 argument that the sign was ambiguous and "concession" can mean free and therefore DOES mean free, but again, POPLA would likely not understand.

So your comment has to point out that they are unable to take legal action against you as Keeper in their own name, meaning they fail to comply withteh BPA CoP.

The contract isnt with a legal entity, and as such has no validity. "Sainsburys" does not eist as a person or legal entity.

This is a precise date however - there is no ambiguity over what 14 days before another date means.

This is also a template so is easier for them to produce.

YOu can prepare a lot of the bundle now
I would also suggest once this is overwith that "dear Linda" ends up with an injunction on her desk...

BUt only if you get sight of the claim in time. If you dont you have a CCJ against you, and the first you may know of it would be when a mortgage is denied, or even a mobile phone contract

Theyre clearly private!

If the signs could not be seen then there could not be a contract
If the car park is covered by BYELAWS theen there cannot be KEEPER liability, so it is important the driver is NEVER revealed.

They do not have to exempt you from charges.

So, what do the signs say.

They can use ANPR. THey can use ANPR. It is the *council* who are barred, but POPLA will not care that this also means their *agents* would be barred. They do not considere whether any amount is legally owed - at all. ALL they care about is whether it was issued correctly.

Yes, we all nkow this is wrong.
But it wont matter to POPLA.

Its almost like they can just raise a claim, regardless of what theyve written to you before. If they wait nearly 6 years you might have moved, fail to defend and therefroe you get a default against you

Your vast knowledge of how PPCs operate should tell you that theyre not exactly above board and honest.

Failing to comply with POFA means the Keeper has no liability.
Trying to add unrecoverable sums means any reward should be reduced, IF they win.

You cannot just "put an argument and win the case". You put EVERY argument that applies.

You are assuming that courts run on black and white. They do NOT.

ALL debt collector letts can be ignored.
Or you write AS KEEPER back to the PPC and state this is the first contact and of course there cannot be any Keeper liabiltiy as no notice was served within 14 days, and no windscreen notice was on the vehicle.

You need to explain that the land is not relevant land. Succinctly. You have gotten half way there, but not completely. "The council are not allowed..." onwards - delete. UTTERLY irrelevant to POPLA, who do not consider anything to do with legality. Also POFA doenst HAVE to apply in order to gain access to the RK database.

Absolutely, you point out that an implicit choice of "drivert" proves nothing other than that the Keeper did not spot the operators sneaky choice of default.
You appealed as keeper, this was clear from the appela - presuming it was. FGiven we havent seen it.
